Timeline

Hi All,

We have prepared the i129f set and will send the package on January 05, 2015.

Please correct if I am wrogn:

1) The petitioner can send all pages of passport instead of birth certificate to prove US citizenship?

2) we met online on wiziq.com in December 2012 and but there is no correspondence but we have attached facetime, viber, iMessages for last 6 months to show ongoing relationship.

3) we have attached cover letter, i129f, explanation of meeting question, g325a for both, passport size photographs, all pages of US passport, chat messages, letters of intent, photographs when we met. Please let us know if we are missing something.

It is best to send in a copy of your birth certificate. Have you meet in person? You will need to include the evidence of the meeting as this is one of the requirements.

Thanks for your reply. She does not have a birth certificate and it is lostI guess.

We have met in person and including boarding passes and stamps and some photographs.

We won't get RFE for not including birt certificate right? We are including all pages of passport.

It's better to be safe than sorry. You don't want to end up waiting longer beacuse of a potential RFE.

It's better to be safe than sorry. You don't want to end up waiting longer beacuse of a potential RFE.

What is the source of this advice? The instructions clearly state that a copy of the entire passport can be used instead of the birth certificate.

For your information I know someone who got a RFE because of a missing passport scan. I just noticed that most of your comments are negative and you barely agree with other members. JUST SAYING!!

The fact that I'm questioning your advice doesn't make my comment negative -- quite the opposite, in fact. Accurate information will be much more useful to the OP than advice which is not based on the facts of how the process works.

If this person you know was missing copies of some pages in their passport, then that explains the RFE, because it asks for a copy of the entire passport. But to say that a birth certificate is preferred simply because you know someone who didn't follow directions and then got an RFE for it is misleading and in this case could cause the OP an unnecessary delay.

It has nothing to do with my opinion. The instructions don't require a copy, so you don't send it. Just put the number in appropriate place on the forms.

DIFFERENT people got RFE for not sending the birth certificate and even the ones who sent them got RFE requesting the LONG VERSION of birth certificate, even sending ALL PAGES of their passport. The instructions say you CAN send ALL pages, HOWEVER if they have doubts on the citizenship for any reasons they will ask for the birth certificate. Let's be honest and agree than seeing the birth certificate is way easier than checking if the petitioner sent ALL pages of his passport tho. Think like somebody who sees many cases a day. I am not questioning the instructions, I am just giving my opinion based on facts that people say here. I suppose you don't make time to read other threats before replying and probably that's why the majority of things you say seem so distant from the reality, since it's all based on the raw instructions (For instance the post about CSC and TSC). Emcia gave her opinion based on facts from people's experience here as well. The instructions MUST be followed, I agree, however the things are not so clear and even at the USCIS they don't follow their own directions. For instance they requested wedding plans evidences from a couple applying for a K1 Visa and the guy was thinking about making a video of his meeting with their wedding planner or venues visits. WHERE in the instructions you read we need to send EVIDENCES of WEDDING PLANNING? NO, they don't exist. The instructions say you need to clearly state you have to get married within 90 days from the beneficiary arrival, I didn't do so and got approved with no RFE, it's the other side but what I am trying to say is that it depends on the person looking at your case.

The petitioner should be able to request a copy of the birth certificate online, it shouldn't be hard to get, but I guess it depends where the person is from. In my case my fiancé (USC) just went online at the Vital Records website (He is from New York), he paid and after few days it was sent to his place (Short version). Just to add more proof of his citizenship I also included the bio page of his passport. The stamps I sent along with the evidences of meeting in person (I didn't send all the pages since we had the bc). I agree with Emcia and I think it would be better to send the birth certificate as well, but if you don't have anymore and not able to get a new one, just send all the pages of the passport. Some got RFE for that but some were OK. Even though we o everything perfect we never know what can happen. I messed up so many things and got approved and my interview is properly schedule!!!

Since you asked if you're missing something: I would add a Cover Letter to list everything you're sending them. Don't forget the payment (We sent a check). I assume you all don't have any criminal records (If so you need certified copies) and never been married before (If so, Divorce Decrees).
