How does one "reconcile" over the phone exactly? Seems if things were on the up and up she would have returned to you. I hate to say this but some nationalities seem to have a higher propensity for immigration fraud (this is not me speaking, check out the stats from USCIS.) Since you provide no information on where she is from, or a timeline, or, it seems, anything else, little advice from people with similar experience can be offered.

Perhaps she found out she needed the OP to obtain legal status.

Hi everyone,

We are back living together and repairing the marriage. Things are going very well. However, I called USCIS and asked them about refiling today. The man on the phone (Tier 2) said some things that did not seem to jive with what people on this forum have said with this post and others. He said that she must return to the Philippines before we can refile. And that we would have to refile as "alien family member" or some such thing. I repeated the details and again he said she must leave the country. Is this true? My impression from reading this post and a couple others were that we could refile with her living here. We'd have to pay the fees again but that she would have a good chance of obtaining the AOS if we explained about how we had some disagreements but had worked hard to resolve them.

A few facts: She came here on a K1 visa, we were married within 30 days, she filed for the AOS but did not get the green card yet.

One other question: is it possible to reverse the cancelling of an I-864. I was told it is but the representative on the phone said no.

Thanks so much! I realize we have made such a mess of this situation but our love is very strong even though I'm sure from the outside it raises doubts about each of us.

No, you will have to wait for denied letter, and then refile.

It is the misinformation line for a reason. I was once told by a phone rep that to get any information about my pending I-130, I'd have to go to Copenhagen and stand outside the embassy until they let me in. No appointment, no other information.

Copenhagen doesn't process immigrant visas.

2 options, 2 paths, pick a path based on what you learn at local office.

1. go into local uscis office together, on an infopass appointment, check status of I-864 withdrawal. if no record of it, ask shift supervisor to flag the casefile for adjudicator review.

2. file I-130 + I-485 . No need to leave USA.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
