:ranting: i've already spent almost 2 years apart from my husband

:crying: ....and we are in AP 233 days now. :ranting:

:clock:7 months 19 days since approval at Interview. :clock:

That's so awful. *hugs* Just imagine how much worse it would be if we all had to wait on a waitlist for a number to come available and then people had to sit in AP. AP is so awful. I'm so sorry.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

There is a little info from people about this here....we are using our assets so sure.... we are a little bit worried how COs see this...and especially about domicile stuff.. Guys what do you think...: driving license, maintaining bank account, transferred money to us account, have sold real estate in EU, and my USC wife's kid going to school in US from last year? Ehm.....huh huh

Hope everything will go smoothly.

I took this from another thread posted by Dewheels and it's a lot of great information, so here you go. :D

Here is the domicile checklist some ideas. All the things you said he doesn't have he needs to get.

What if I (the petitioner) live with my spouse in their foreign country? Do I need to include anything in either package?

You'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. Please read the I-864 instructions (pages 3 and 4) for information about it. This is NOT needed if the petitioner is living in the US. Here is a sample cover letter to include in the package (it lists MANY possible documents, some may not be applicable of course, to prove that you have, or will re-establish, domicile in the US):

NAME

SOCIAL SECURITY NUMBER

FORM I-864

Part 4, Question 5: Country of Domicile

I, XXXX, am currently residing in FOREIGN COUNTRY with my spouse, SPOUSE'S NAME. Below you will find a list of attached documents to show that my principle residence is in the US and the steps that I have taken to return to the US with my family.

Steps I have taken to maintain US Domicile:

• Maintained my XXXX voter registration

• Maintained my XXXX credit card registered in the US with a US PO box

• Maintained my bank account at the XXXX Credit Union

• Maintained my bank account at XXXX Bank

• Maintained my XXXX drivers license

• Maintained my US retirement fund through XXXX

• Maintained my US investment account with XXXX

• Maintained my US PO box

• Maintained licensure by the XXXX

• Maintained membership in the XXXX

• Maintained my automobile in care of my parents

Supporting Documents for the above steps I have taken:

• Voter registration card showing permanent US address

• XXXX credit card statement showing US billing address

• XXXX Credit Union statement showing permanent US address

• XXXX Bank statement showing permanent US address

• XXXX drivers license showing permanent US address

• Retirement fund statement showing permanent US address

• Mutual fund statement showing permanent US address

• XXXX license currently up to date

• Renewal of XXXX membership

• County tax bill showing I still own a vehicle

Steps I have taken to return to the US to take up residence:

• Made arrangements for us to have a house to live in

• Contacted schools for requirements of things to bring to register my children in school

• Contacted my auto insurance company to find out about re-instating my insurance on my car

• Contacted shipping company for estimate of costs to ship belongings

Supporting documents for the above steps I have taken:

• Lease agreement for our house

• Email from schools regarding registration requirements

• Email from my former auto insurance company regarding my inquiry

• Email from XXXX with estimate and correspondence regarding shipping our belongings

I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of spouse's admission into the US.

I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.

Just wanting to say hi to Soloenta and all the peeps still slogging through this mess!!

SOLOENTA!! We're so close to the MONTH your interview is in!! So exciting! I assume you have a countdown going! Are you going for the interview? Or is it too crazy/expensive?

MOLLLLLLLLLLLLLLLYYYYYYYYYYYYYYYYYYYY I've missed you so much but so happy your out of this hell hole! Yes it's getting close and I'm scared and my husband is starting to get nervous after he was so calm about it. No wont be going to the interview since they wont let me in and we don't know whats going to happen. But if God willing my husband gets the Visa I'll fly there to come back with him after she closes everything he has to then a few days to take it easy then home. I pray God grants us this happiness after such a long struggle.

Thank you my precious angel for coming to check on me and everyone else still stuck here. :D God bless you and how is your husband doing since let's face it he must miss Chile? I know my husband will miss Egypt. :( if all goes well will try to ease that part of moving.

Love you girl!!!!!!!!!!!!!!!!!!!!!!!!!!!! Please don't stop praying for us. t5063.gift5063.gif

Hey Frips,

As a fellow USC'er living abroad with the hubby and *only* using assets for the AOS I can tell you what we did (and it looks like you have enough especially having a driver's license, bank account and the schooling). We have a bank account in the US and two major credit cards that are constantly showing transactions (as all those birthdays in the US!). That seemed to be enough. We are using my mother's address as we do not have a house in the US as of yet and that is just our 'principal' address' - when we get there we will be put up in temporary housing by my husbands employer.

We had no issues with the domicile with that information and if you are relying on any part of your AOS in assets alone you will receive a warning 'checklist' after your 60 days (or after they review your case) -- don't freak out about it, it's merely a statement that says NVC isn't the one to look at assets and determine if it's good enough, that's up to your consular official. You need to make sure it's enough and that you have assets that can be converted to cash within 1 year (without putting strain on the family). Our interview went fine as we had cash that was over the poverty line so nothing else was asked.

Good luck and praying you get through fast!

Oh dear, everytime I see your case on here I cringe. I'm so sorry that you've been put in this lengthy process! Praying my little heart out for you dear!

:ranting: i've already spent almost 2 years apart from my husband

:crying: ....and we are in AP 233 days now. :ranting:

:clock:7 months 19 days since approval at Interview. :clock:

I know folks have resolved this question for you, but just to shed some light - anytime a NVC rep makes comment on your account (and they make comments every time you call, get a case complete or any other form of movement with your case) that could possibly trigger a mail. Not all comments on your account trigger movements (if you just call in and they say wait and you hang up...that will probably not trigger anything).

Hello All

It's not easy to help you because you didn't fill out your Timeline so we have no clue what country/Embassy you will be given an interview to and it's all specific to the country your in. Over two months wondering what Embassy this is?
