Does my case fall under the Adam Walsh Act

Hi,

I am a UK Citizen and my wife is a USA Citizen. She made a few poor judgement calls in her past and received two misdemeanor charges for corruption of minors and endangering the welfare of a child. She was never required to register as a sex offender and she was only sentenced to probation which she completed successfully over 6 years ago.

I am worried now that this will impact her ability to sponsor me for a spouse visa.

Can anyone provide any information on this?

She should consult with a lawyer familiar with AWA-related issues. It sounds like it may be a problem.

I dont know if you are being intentionally vague about the charges or not, but it doesnt matter. You can google when does the awa apply (in regards to uscis) and it will give you the specifics of it, but basically it has to be a 'specified offense against a minor' so even better google that.

Offenses like that basically involve things that are sexual and include minors but also include kidnapping.

I have a similar situation here. My husband (the petitioner and US citizen) was convicted of a non-sexual misdemeanor which does not require him to require as a sex offender and all he had to do was 2 years of probation. He was originally charged with indecent behavior with a juvenile which is a sexual offense, but it was amended to that non-sexual misdemeanor ("improper telephone communication - harassment"). I have the same questions about if this would still fall under AWA...since he was never convicted of a sex offense that involves a minor.

I don't think so, since his conviction is likely not covered under the AWA. The advice of an attorney who is well versed in AWA-related issues is probably a good idea to seek though.
