Hi Everyone

Myself going to get married to an greencard holder (permanent resident) in india in feb 2015. it is an hindu arranged marriage.

Which is the shortest way to move to usa ?

is direct consular processing applicable for greencard holders as well ?If so anyone tell the process or corresponding links

Anyone kindly suggest me to get things fast ......so that I can Plan ahead in advance

In theory a green card spouse can apply via direct consular processing but they still must wait out the priority date before they are eligible for a green card. You are looking at a 2 year wait currently but this timeline can move all over the place.

This will not be over quickly. You will not enjoy this.

There is no shortest way to bring over a spouse of a GC holder because that category (F2A) is limited by visa quota. You'll move to the US in about 2 years depending on the Visa Bulletin so DCF provides no help in speeding things up.

Once you have your marriage certificate, have your spouse file i130 ASAP.

How long has he been a GC holder?

No.

You can't adjust your status in the US till your PD is current, so still about two years of waiting. And as the LPR spouse, you have to maintain a legal status for the whole time.

Besides, going to the US with non-immigrant visa with the intent of immigraiting it a visa fraud.

once the marriage is done with a greencard holder. can i move to usa with a l1 visa which takes shorter time and change the status after moving to usa . Is this a good idea ?

L1 would be an excellent choice, no need to wait until you are married.

is this ok kindly let me know

" getting married in india as per traditions. she will go back to usa as she have the greencard holder. after that i will go back with l1 visa . after reaching there we will get married and change the status ? is that ok

i hope there is nothing wrong anyone kindly help.......we cant stop the marriage or cancel due to visa. at the same time it is difficult stay far for 2 years and we cant break the rules as well so looking for a solution......

if so then

1.is there any chance of getting l1 visa rejected ?

2. any quota for it

3. time to get it

L1 is dual intent.

No visa is guaranteed

No quota

Pretty quick, if everybody is on side. Are they?

You are talking about L1 visa, right?

You are working in an US company branched in India and they/you are thinking about transferring you to the US, right?

So maybe your company will be more informed about that kind of visa and they could explain everything to you more clearly.
