After thinking about it further she is correct you will likely have to paper file. As she says in the wiki if you file MFS then you can put NRA for the spouse's Social Security # but that is prob an e-file rejection error that will bounce it back.

Unless your spouse has already entered the country legally and has their Social Security #.....in that case you are fine to e-file.

Hey all,

Usually people mention here about calling the NVC for various reasons, but today my wife's cell phone rang when she was at work and it was the NVC calling her! They were calling to verify I'd be at my interview next Tuesday and went over what documents to bring with me. My wife said the lady was very nice and they chit chatted about the weather for a bit. NVC lady said they had about 2 feet of snow there and was surprised how little we have here in Toronto. I'm looking forward to my interview, but will be so glad when it's all over.

This is exactly the reason why you can't e-file. Online tax programs don't accept letters (NRA); it has to be a SSN# or ITIN#.

can I still use Tax prep software such as TurboTax if I plan to use NRA and print and mail my tax returns ?...Or should I use assistance of CPA ?

I'm not sure, cause it might stop you at the point asking for your spouse's SSN and won't let you continue until you input something. If you can bypass it, then yeah, just use it, then hand-write in on the form at the end 'NRA'.

The state matters if you live in a community property state and file MFS. Even if the spouse has a SS# or ITIN#, ......you will probably get e-file rejections. You do in turbotax.

So I called today to see if I had an interview date....well apparently now I don't have a case complete. Site still shows 3 NAs. I've called since December 30th and have called several times and everytime they said case complete. Now he said it's waiting to have a case complete. Wow I don't even know what to say.

This is all so comical now.

USCIS

January 8th 2014 - NOA1

July 10th 2014 - NOA2

NVC

July 17th 2014 - Case shipped to NVC

July 30th 2014 - Case received by NVC

August 13th 2014 - Case number and IIN received by email

August 13th 2014 - DS-261 Form Completed

August 14th 2014 - AOS Fees Invoiced and Paid

September 17th 2014 - IV Fees Invoiced and Paid

September 19th 2014 - DS260 Completed

October 6th 2014 - AOS and IV Packages Received

November 28th 2014 - AOS and IV Checklist (4 items in total. 3 for documents they lost. Called on December 9 and a rep said no checklist for IV....go figure)

December 8th 2014 - Checklist scan date.

December 30th 2014 - Case Compl........NOT. So after not having an interview date yet, I called again on Jan 30th and apparently its in final review with a supervisor.

February 6th 2015 - Case Complete: Supervisor called from NVC to confirm everything has been completed now.

March 27 2015 - Interview Date

March 27 2015 - Approved!

I filed MFS(first time filing as married) using turbo tax, my wife had previously been in the states on a student visa and obtained a SSN. I live in MA, turbo tax had me print out the 1040a for federal and mail it out to the IRS. Wasn't able to e-file federal, just state.

No, I was referring to the state doesn't matter in reference to putting NRA and not being able to e-file. I wasn't referring to e-filing with a SSN/ITIN. I should have been more clear on that.

I haven't gotten to the NVC step yet this time around. But I have been reading up on the tax filing aspect since of things since I am filing with my husband this filing season. I don't recall where, but i thought it says you can no longer file using NRA. You have to apply for an ITIN for your spouse in order to file them on your taxes...is this not correct?

I haven't gotten to the NVC step yet this time around. But I have been reading up on the tax filing aspect since of things since I am filing with my husband this filing season. I don't recall where, but i thought it says you can no longer file using NRA. You have to apply for an ITIN for your spouse in order to file them on your taxes...is this not correct?

If you file for MFJ, then yes, an ITIN is required (if one doesn't have a SSN). If you file for MFS, you can just write NRA in the SSN field.

Ok...Thanks!!! I was kinda stressing out about it...I'm either going to file MFS or HOH since i qualify for both. Whatever gives me the biggest refund...So HOH I can still use NRA right?
