Hi Guys,

Was hoping for a bit of advice. My husband (the peitioner) is in the US right now and has been ill in hospital for the last week.

What is the process for expediting a case based on medical reasons? What is the criteria to even apply for an expedite? I am a nervous wreck being so far away from him when he is very sick.

My case was scanned in at the NVC on the 28th of November 2014 and I am also waiting the 60 days.

Is anyone else finding their case is completed before the 60 day mark?

Thanks again!

Our scan date was November 7th, and I logged in to CEAC on Friday and found AOS to be N/A. Now assuming this is a CC and that it was on January 2nd.

The CC came 36 business days after our scan date.

I'm new to VJ and am still trying to get familiar with things... :P

My husband is american (living in VA) and I am Canadian living in Ontario, fairly close to the NY border but unfortunately still 11 hours away from my love. My husband and I started our process in November and our I-130 was approved in around 21 days! :) which I've heard is rare, so I'm quite happy about that! Just yesterday we called NVC and were told our case has been received but still has not been assigned a case number... I'm wondering if there's any way to expedite things? I mean, I'm aware it is doable... But I'm wondering how? I've searched and searched online but have had trouble finding a list of valid reasons as to how we could possibly go about it. My husband is in the military and I've been told that can benefit us but he just recently got out of active duty so I'm not sure if that changes things a little, or a lot... hoping someone can answer my question! Please and thank you :)

The expedite criteria list for NVC is similar to that of USCIS's, which you can find here: http://www.uscis.gov/forms/expedite-criteria(NVC doesn't have a list anywhere on their website)

Sigh. Sixth month at NVC. 24 days post last scan date.

Can I ask a silly question? What happens when you get CC? Do you have to do a billion things and collect a billion forms before you are allocated an interview date? Or does that happen automatically without any action from you? I guess what I'm asking is, how can I speed up the time between CC and interview date, is there a way to make that the shortest time possible? I'd like to be as prepared as possible. Maybe this is the wrong thread to ask.

No, you don't have to do anything. When your case is complete, NVC puts it into the queue for an interview date to be assigned. This is done automatically, no additional forms or documents are needed. Once an interview date is assigned, then you'll receive the P4 letter (interview letter). Then, typically within a few days of an interview date being assigned, NVC will ship the case out to the embassy/consulate. You can read more about this in the NVC wiki I wrote ;)

Hey all!

I'm new to this forum but we are knee deep in the IR-1 process, almost ready to send in our AOS documents.

Can anyone tell me how it works when I (the petitioner) don't qualify as the sponsor? My parents will be sponsoring my wife, but I still have to fill out the I-864 and send in all the documents right? Do I send all of it in together with my parents' documents and forms? Or do we send them in separately?

Lastly, our process is going through the consulate in Rio de Janeiro. Do we send our AOS and IV documentation to the consulate in Rio or to the NVC?

Send your I-864 and documents together with the I-864 and documents from the parent who completed the form.

All documentation is to be sent to the NVC, not the Consulate.

Phew, finally went through the past 2 weeks of spreadsheet requests! And since it's a new year, added a new tab at the bottom for 2015. Anyone that didn't have a case complete on the NEW layout has been automatically transferred over. As for the old layout, I went through the list and updated what I could. Sent messages to those that I thought should have updates by now. I think for the old layout, I'll just leave it as is and when those on it get case completes, I'll just move them up on that spreadsheet (so there will be a few 2015 case completes on the 2014 spreadsheet). I'm not going to create a new tab for just ~30 people with no case completes yet

For those on the new layout, please verify if everything is up to date. There's quite a few people on there in which I haven't heard anything in awhile. Thanks :)

And for the few months that the new spreadsheet was active for 2014, these were the final averages for each (calendar days, not business days):

NVC received to case number assigned: 19 days

Case number assigned to AOS bill available: 9 days

Case number assigned to DS-261 available: 9 days

DS-261 submitted to IV bill available: 36 days

Package scanned to checklist issued: 47 days

Last package scanned to case complete: 50 days

NVC received to case complete: 125 days

So, it's taking about 3 weeks to get a case number assigned once NVC receives the case from USCIS (less than half than their quoted time of 42 days). And it's looking like NVC is taking less than the 60 days they're quoting for reviewing packages. And from start to finish, it's taking about 4 months on average to get through NVC now.

Everything is right except the bolded statement. What AOS form you file is NOT dependent upon what tax form was filed. To be able to use the I-864EZ, you need to meet the 3 criteria, regardless of tax form.

The only time what tax form was filed comes into play is on the question asking for previous years' tax information. That's when it matters as that determines what amount to use.

Yes, just send ONE photocopy to NVC. You'll then bring the originals with you to the interview where they'll inspect them (and possibly make their own photocopy, who knows) then return them back to you.

Thank You Saylin for the correction on I864ez and tax form used.
