Hey all!

I'm new to this forum but we are knee deep in the IR-1 process, almost ready to send in our AOS documents.

Can anyone tell me how it works when I (the petitioner) don't qualify as the sponsor? My parents will be sponsoring my wife, but I still have to fill out the I-864 and send in all the documents right? Do I send all of it in together with my parents' documents and forms? Or do we send them in separately?

Lastly, our process is going through the consulate in Rio de Janeiro. Do we send our AOS and IV documentation to the consulate in Rio or to the NVC?

I have one question: as NVC no longer requires ORIGINAL documents, but photocopies instead, how does it work now? I will try to make my question clear: the requirement was to include original documents AND a photocopies of each original document to the packet. I assume, they used to keep copies and send the originals to the embassy.

Do we have to send ONE copy now of each required document or two? It may be a silly question, but still want to make sure I won't make mistakes.

Everything is right except the bolded statement. What AOS form you file is NOT dependent upon what tax form was filed. To be able to use the I-864EZ, you need to meet the 3 criteria, regardless of tax form.

The only time what tax form was filed comes into play is on the question asking for previous years' tax information. That's when it matters as that determines what amount to use.

Yes, just send ONE photocopy to NVC. You'll then bring the originals with you to the interview where they'll inspect them (and possibly make their own photocopy, who knows) then return them back to you.

My husband is american (living in VA) and I am Canadian living in Ontario, fairly close to the NY border but unfortunately still 11 hours away from my love. My husband and I started our process in November and our I-130 was approved in around 21 days! :) which I've heard is rare, so I'm quite happy about that! Just yesterday we called NVC and were told our case has been received but still has not been assigned a case number... I'm wondering if there's any way to expedite things? I mean, I'm aware it is doable... But I'm wondering how? I've searched and searched online but have had trouble finding a list of valid reasons as to how we could possibly go about it. My husband is in the military and I've been told that can benefit us but he just recently got out of active duty so I'm not sure if that changes things a little, or a lot... hoping someone can answer my question! Please and thank you :)

Can I ask a silly question? What happens when you get CC? Do you have to do a billion things and collect a billion forms before you are allocated an interview date? Or does that happen automatically without any action from you? I guess what I'm asking is, how can I speed up the time between CC and interview date, is there a way to make that the shortest time possible? I'd like to be as prepared as possible. Maybe this is the wrong thread to ask.

Hi again fellow Canadian! Generally the only way military can get an expedite is if they are active duty with a deployment imminent. My husband is retired military and it didn't help us at all. This doesn't mean that if you qualify for another reason for expedite, that you shouldn't apply. Usually they will only expedite if there are severe medical reasons or major financial hardship. There is a list of criteria somewhere I am sure, I just don't know where it is, and if you are already at NVC it could hold up things (stall your application). Unless you do have a major problem where you really need to expedite, I would just wait and go with the process as is, as you have good momentum going right now. Usually the longest wait is for NOA2, and you have that already.

Hi Sharks! The only thing I can think of, and what I did, is to go to your consulate's website and see what they require you to have ready. NVC also sends you a P4 letter telling you specifically what they want from YOU.

That is all you really can do before you get an interview date. In my case, Montreal has a whole list of documents they require in a certain order, and instructions on how to sign up for Loomis courier service. Make sure you have enough passport pictures. That's about all you can do. If you have all your docs ready up to this point, there really isn't much more to do other than wait. Good luck friend :) !

Thanks Dualie! I did what you said and there was good info on the Sydney Consulate website. I now feel much more prepared! It is telling me to gather my original documents but I guess that doesn't include the stuff that I already sent to NVC. :)

Hi Guys,

Was hoping for a bit of advice. My husband (the peitioner) is in the US right now and has been ill in hospital for the last week.

What is the process for expediting a case based on medical reasons? What is the criteria to even apply for an expedite? I am a nervous wreck being so far away from him when he is very sick.

My case was scanned in at the NVC on the 28th of November 2014 and I am also waiting the 60 days.

Is anyone else finding their case is completed before the 60 day mark?
