Hey guys! We are sill waiting for the IV Fee to appear, but in the mean time I am trying to get everything together so we can send it ASAP once we get the OK.

My 2 questions (today) are:

1. If I (the petitioner) fill out the I-864 and include a letter stating that I do not meet the requirements to be sponsor, do I still need to include all the documentation? I didn't file taxes the last 2 years because I made so little, and my boss is not being cooperative when it comes to the letters from my employer stating how much I earned and so on. Do I really need to include a bunch of proof that I make very little money here in Brazil? Especially when I won't continue with the same job once we move to the states, and considering that my parents will be sponsoring my wife.

You shouldn't have to prove any of your income from Brazil just write a letter stating why you didn't declare and quoting the IRS doc where it states that you weren't required to file. Something like this but about your own case:

I (the petitioner) was not required to file income taxes during the past three years as I have lived abroad with my husband and worked part time as an English Teaching Assistant. My income never reached the minimum value which requires the filing of income taxes by the IRS as stated in the “Filing Requirements” section of the Publication 54, Tax Guide for U.S. Citizens and Resident Aliens Abroad (attached). For this reason I included a joint sponsor.

Make sure that you don't leave anything in blank on the form (putting 0's and N/A's in the appropriate locations) or you will get a checklist as I did :( I would recommend calling NVC and asking them if you have any questions about what to put. Much better to ask them to walk you through it now than wait until after you have already made a mistake. None of your specific income should be stated on the form as long as you really weren't required to file as the information they request is taxable income. If your income was not taxable it doesn't count. Good luck!!!!!

Congratulations! :-). i have 7 nov scan date too but still waiting for a CC. Keep praying for us too :-)

new to the nvc process, NOA2 date Dec 3, 2014

just got off the phone with NVC...

I started calling at 938 pm and just got off....wow, what a wait........is this normal???

I must have redialed for 20 minutes then got connected......and was on hold for close to an hour..

anyways, I've been reading that people are being told to wait 42 days for a case number.....

well this is what I was told....

our case arrived, is in the building and was logged into the system on Dec 30....we need to wait a couple more weeks at least before a case number is assigned and is mailed out. if we haven't received anything from the NVC within 42 days from Dec 30th then we need to contact them to investigate

the guy I spoke to was most helpful but spoke to n script (or so it seemed)....think his name was Dexter.

I guess this clears up any confusion......and gives us a good indication that nothing has changed at the nvc.....it's still very backlogged....... :diablo:

In general, if the checklist is that specific, then it is NOT a false checklist.

1. Do u have a copy of the form i-864a you submitted and verify if the signature is there or not ?

2. The part 2 has to be signed by the household members (spouse for example) of the joint sponser. Are you sure that part 2 was signed by this household member ?

My husband (sponsor) and the household member both signed and dated the form so its a big question mark why we got a checklist??

Husband also mailed me all the copies but i still didnt have it guess it will arrive next week.

Can we ask for a supervisor review at least???

I suggest you call NVC first thing in the morning tomorrow to confirm. I bet it's not a false checklist since it was specified in the email. Check part 2 on your copy of the I-864A maybe the sponsor and household member didn't placed their signatures and date on the approriate line. Maybe they interchanged it or something. We'll never know till you give NVC a ring. Goodluck!

My husband just called NVC and wow why most of the rep are so rude like she's having a menstrual period.. her voice is on high pitch til the end of conversation.. you asked nicely and get a rude respond. They shud find another job if they dont want to be asked. SMH
