I have to apply for the Removal of Condition, I-751. I can apply within a 90 day window prior to the expiration of my conditional 2-year green card. That window period starts on the second week of January. However, I don't get my W-2 until after January 31st. My wife is the petitioner. We filed joint income tax ever since we got married. I was thinking I could use the 2014 joint income tax returns as a proof for bona-fide marriage. Thank you.

We have filed two joint taxe returns so far. For 2012 and for 2013. They already have our tax transcript for 2012 which we gave them during the initial conditional green card interview.

I think you should still resubmit the 2012 tax return with you petition. You need to try to submit it as early as you can within that 90 day period from everything ive read on here. But i see what you are saying. It would be a good extra evidence but you need to leave time incase your petiton is lost in the mail, or if you did not fill out your form correctly and need to resubmit it. They also need time to issue you your one year extension. Alot of couples on here submit only 2 years from what ive seen. I think that waiting for the tax return might be pushing it. But then again there are lots of couples that wait alittle before filing because they dont have there packets finished yet. I think that if you wait till you get your w2 and then you have to wait to get your tax return back it may take to much time.

Thank you so much for your help! We will file with 2012 and 2013 tax transcripts and inform USCIS in the cover letter that we will be filing jointly for 2014, so if they need that tax transcript, they could request it.
