Low income apartment problem

My finace is living in one of those low income goverment run family apartments, you have to be U.S citizen. Once i marry her on k1 and change status

will i able to stay there with her if i tell them we are married and are waiting for my greencard to be recieved?

Yep...once you get there as long as she is considered head of household on her housing program you can be added. Note: if you are added they will want you to report all income because the rent will be adjusted and her portion will be increased and theirs decreased. It could jeopardize if you as a couple remain qualified because there are income limits. Hope that helps!

You should be living with your wife during your adjustment of status.

It's not until after you get your green card that she will be held liable for the means-tested benefits.

Yes you guys can live in the housing - no it's not considered a means tested benefit.

HOWEVER, keep in mind that the I-864 and poverty guidelines are still intact here. She still needs to make enough income OR have a joint sponsor who does for you to even get a green card.

Married couples are allowed to live together in housing. Just like previous poster stated, when u start working at the end of lease term, income is reevaluated for remaining in apartment.

Do you know if it is section 8 or section 42?

I know that section 42 housing would be alright. someone may be above poverty level but still eligible to live there, however as above posters said, there is still a limit

So petitioner files a I-134 and I-864 saying they will not become public charge, and then you are going to move into a Federal housing.

I wonder if that will be an issue in the future for the petitioner?

I wonder if that will be an issue in the future for the petitioner? Read my above comment, only if the the beneficiaries income combined with the petitioner increases above the standard payment. Or if the housing program is not notified that there is someone additional living there and it gets reported back to them. Also the the housing program is not means tested so no public charge, if it was means tested the petitioner would be the public charge not the beneficiary.

LPRs, regardless of time spent in the USA, are likely eligible for either section 42 or section 8 housing, at no charge to the sponsor(s) but must comply with the income requirements to be eligible. Just like anyone else.
