How will AOS be affected with hubby in jail?

Hello all

I came on a K1 visa, got married and filed for AOS. After AOS was sent, my husband who is the USC got jailed ( won't go into details-too long story). My concern is with my husband being in jail will that affect my AOS? Surely he will have to be with me during the interview? So how to deal with that? We just got married when he was jailed, his lawyer says that it will be a while for the whole thing to be over, and we have not been able to do anything yet like opening a joint account etc etc Also I have filed for AP but I have not received any AP yet, so can I and how to expedite the AP process? Thanks all

To expedite AP,you usually need a reason. What is your reason?

Having the husband in jail will be an issue; keep in mind that it can be 6+ months until the interview, so things may be settled by then and your husband back home. Even with him in jail, you as his wife should be able to get "power of attorney" and be able to get put on bank accounts etc.

I am sorry to hear that. You should be able to make an info pass appointment, or even try a walk-in to your local office, and get emergency AP.
