i got no RFE for medical yet maybe they gonna sent it next they been quite since Sept 9 i try to call they did not tell me any info abt my aos case ,the only answer they say to me was everything is still pending they will let me knw via the mail if they need anything

Hi Sandranj and VJ members,

i will like to say a big thank you to all the vj members that always share their experiences and time frames in this forum ,that really gave a big relieve to so many of us especially me.please i have a quick question

i got approval notice for form i765 and card was sent to my ATTORNEY office on 9/28/2015 and USPS tracking was showing delieverd to her office but she claimed she never receive any card.After searching for it in her office nothing was found, finally she apply for replacement and she indicated card never received on 11/6/2015 but till now i never receive anything and the online status is not showing anything new.Thank you as i await for your reply.

Dear VisaJourney members.

I married a wife.

She got more than ten thousand dollars from me within 6 months through lies and deceptions

She threaten to deport me from United States that I am an illegal immigrant (I am not)

She fraudulently converted the apartment I bought before I met her to her name. I am in the processing of getting my apartment back in my name.

She told me she never married before when we met, I later discovered her previous marriage was not terminated. She refused to provide evidence that her previous marriage was terminated or that her former husband was dead.

She pressured me many times to do unwanted sex acts I am not interested in (It will be too graphic to describe here)

I am suffering from depression, fear and anxiety because of this.

She told me when we met, she has a good job. I later discovered it is a lie. She is jobless.

She is threatening to take half of my properties and assets, in spite of being married for less than a year.

She told me when dating, that she never had any court case. I later discovered she is a convicted felon and had many criminal cases in the past with financial frauds and forgeries.

We no longer live together. I am very afraid she may kill me and arrange it to look like accidental death or natural death.

She was nice initially when we first met, but over the time she became controlling and abusive.

She held me hostage in my car 3 times until I agree to give her money.

I never made any police report.

Do I have a VAWA case? Thank you.

Hey johnvawa, I can relate to you as I feel your pain. I think the first thing you need to find out is if she was divorced when she married you or if she was still married to her ex. If she was still legally married to her ex when you guys tied the knot, that would make your marriage to her invalid. At this point you wouldn't be able to apply for vawa.

If your marriage is in fact valid then I think you do have a shot at filing vawa.

Really? I didn't know that. I read the contrary somewhere online, about some lady that was married to a guy that was already married, I will try to find the link but thanks for the info anyways

Geoheaven if the OP wife never divorced her previous husbands just this fact is not ground for Vawa. VAWA can be filed based in extreme cruelty and /or physical violence, lying about her previous marriage status is not a ground for Vawa. Extreme cruelty is a repetitive pattern of humiliation, degradation control, isolation etc..

Bestblue even if his wife never divorced her former husbands he still qualifies for VAWA, if he didn't know about that BEFORE getting married.

jpsingh the victim has two years after the divorce to file VAWA.

If you do not have a police report you should attend therapy 5/6 sessions and have a psychological evaluation done by a PSYCHOLOGIST, not by a counselor or social worker.Before start attending therapy ask if the professional has any experience drafting psychological evaluations,because I read some evaluations with 2/3 pages that were garbage, and I saw many cases that the psychologists refused to give a psychological evaluation.If you have a police report because you suffered domestic violence you might not need the psychological evaluation, it depends on the nature of the information written on the police report.

Jonh VAWA many things you mentioned here are not considered extreme cruelty (mental abuse) such as:

It's considered extreme cruelty:

She got more than ten thousand dollars from me within 6 months through lies and deceptions.

Considering what you posted here you might have a Vawa case, but you need to explain better in your affidavit the abuse suffered ,and do not include in your affidavit things that are not considered abuse. Extreme cruelty may include acts of isolation, humiliation, exploitation, control, degradation etc. You should see a psychologist and attend 5/6 sessions of therapy and have a psychological evaluation done, but if you tell the psychologist what is not considered abuse, I posted above, you will ruin your case.If you do not have an attorney and need help with your case I can review your case AFTER you have the psychological evaluation done and your affidavit written, but if after reviewing your case I think you do not have a VAWA case I will not help you ok.
