Hi sandranj I have a friend who's currently trying to file a vawa petition she has everything except a copy of her husbands ss /birth certificate can she still submit her vawa documents without it? she do however have the marriage certificate.

If her husband is a US citizen then she would need to provide proof of that, whether it's a copy of his birth certificate indicating he was born in the US, or a copy of a CRBA, or a copy of his naturalisation certificate, or a copy of his valid US passport.

hi Islandgirl.

Including the birth certificate of US citizen husband's is mandatory. It is crucial, if not included her case will be denied automatically.

I waited my vawa case to be approved for 2 years because of not being able to get a hold of my ex's birth certificate. After the denial, my attorney made an appeal, arguing that we submitted his SSN, driver's licence number on police report and court report etc...no luck.

We could not win without his birth certificate.

I am a bit worried can someone help me please. My lawyer got a email in response to a request for update on my pf renewal. This was on sept22 that said that my vawa was approved but today when I checked online the status say it was approved on sept 28. Should I be worried? And how much longer do I have to wait for the notice. And I recently moved but all my documents so far have been sent to my lawyers office do I still need a address update or will they be sending the notice to her as well

Thats one of reasons why I could not submit either. Some states provide certified copy of a birth certificate to the legal spouse.Mine was one of those states that did not provide unless you are a parent or for yourself.

The state he was born only one more excrption to the law. Which was getting a court order. With the court order, you could claim his BC from the state vital department.

I was able to get the court order with the ongoing murder charge against him. But before I did it, I called his mom to see if she would help me. And she did. I hadnt talked to her since I have left.

Well, long story short.

It depends on the state

I even called the clerk. Its long time ago. I remember she said I was able to get a court order.

Wow ok now I see it seems a bit impossible because my state doesn't allow the spouse that kind of info leilabird thank u so much you been a big help

It varies from state to state as to whether a spouse is entitled to a copy of their spouse's birth certificate.
