Hello Everyone,

I am new to this forum and would like some of the experts to shed some light on my case. I married a US citizen last year but our relationship became abusive when my mate encounter drinking problem. I even have a video of my spouse came to the place of my work totally drunk and started talking rubbish in front of other employees and my manager. I almost got fired with her behavior.

I don't have enough proof because I never called police and most of my abuse was encounter in our house. I do have some pictures of bruises, psychological evaluation and my friends and family who know about the abuse.

I filed my case like 3 months ago and have not received any response.

My question is should I continue taking psychiatric therapy (I only had two session until now) where I was prescribed some medicine to focus on my studies. I sometimes still encounter some bad nightmare but my family is very supportive which help me to cope with this bad situation.

I have not received anything from them yet, my spouse also withdrew the I-485 petition that she filed and had threaten to deport me. I told her that I was going back home and would leave everything behind which is why she agreed to give me divorce. I had since moved on and cutoff all the ties with her.

Any advice would be appreciated.

Hello Sandra, my AOS has been at the NBC for 4 months now. Is there anything I can do to have it shipped to my local office in NY?

Hi,

How do you know that your case is still at NBC? Did you call them?

As far as I know, they (USCIS) don't send you any kind of notice once the case is transferred from NBC to local office?

Hi there! I am just new here and I'm trying to gather some information so I can lessen my anxiety.

I met my husband last April 2015 and dated for 3 weeks. My visit visa was about to expired but he was so in loved with me and asked me to get married.

I got married last May 2015 and things changed after that. I suffered domestic violence, which is most verbal, a lot of threats that he's going to tell the immigration that our marriage is fraud. He tried to rape me. We went to a flight and became physical that's the time I was able to get out of the house. I hired a lawyer because I was so scared. My lawyer advised me to see a therapist. I had my psychological evaluation with her. My lawyer filed my application, VAWA, I- 485 and the EAD last April 21. I would like to know how long is the processing time for these application. How many days?weeks? months? before I receive my first notice from the Immigration. I appreciate your help guys. Thanks.

I am not too sure to understand, you and your lawyer filed your Vawa on April 21, 2015 but you got married in May 2015??? If that's what you did then you are not eligible for Vawa. Hopefully you made a mistake in your timeline, please correct it and post the accurate dates in order for us to answer your questions.

FYI Vawa processing takes approx 5 months, EAD takes approx 3 months

From my point of view there is no given time for how long one must be married to qualify for Vawa! But the issue here is the proof for good faith marriage, I don't know if ur lawyer mention that to u. U met him and dated 3 weeks then u got married! I don't know more about Vawa but I think there is more into it before they adjudicate.

Hi there. Thank you for responding to my post. My lawyer filed my application last August 21, 2015, I'm so sorry for the error. I just want to ask, when will I get the first notice from the USCIS? My x husband reported me to the immigration last May 28 that my visa was expired and the marriage is fraud. It's not fraud and I was able to prove the marriage is real. Will it affect my application. Thank you.

Thank you for responding to my post. I met him last April 10 and we got married May 2, 2015. We got separated last may 27. I went to the police to report a domestic violence case against him and went to psychiatric evaluation. My lawyer asked me to provide proof of good faith marriage. My lawyer submitted my application last August 21, 2015. I'm hoping my visa will be approve.

Did you live with him?

What did you send as proof of bonafide marriage ?

You have a difficult case since you met him 3 weeks before getting married, you were officially married with him for only 25 days before you seperated and your husband told USCIS about your marriage being a sham/fraud before you applied for vawa. That raises a big red flag, also the fact that you are from the phillipines, a high fraud country doesn't help either. I am not saying that you won't get approved, I'm just saying that your case is difficult.

If USCIS is content with what you sent them and they decide to give you prima facie, you should get that soon, you should also receive I-797 receipts for all your petitions within 30 days of applying (end of this month). Like I said in my previous message 5 months or less (by the end of January) to get a decision on your I-360 vawa and 90 days (end of November) to get EAD.

I hope you have an excellent lawyer because you will need it!

The time the person stays married is not important to USCIS, but the marriage intention is EXTREMELY IMPORTANT. Dating him 3 weeks and getting married right before expiring your visa might raise some concerns to immigration. You need to convince USCIS that you had a bonafide marriage, because of that describing the COURTSHIPsays 70% about the marriage intentions. I hope you described in DETAILS the courtship, from the time you met him, met his family,his friends etc.The VAWA takes 5/6months to be adjudicated.
