Hey Vj members it's been a while. I did my Biometrics In December 2014 after I submitted my i360 (which was approved In May 2015), i765 and i485 (which was transferred on May 18, 2015). Did they already complete my Background check or do they wait until an Interview date Is set to complete and adjudicate? Trying to figure If the Biometrics contributes to the delay of being given an appointment date. Good Luck as always to all y'all,,,,,God got your backs!!!!!!

The initial receipts are usually separate from the biometrics appointment, which comes a month or so later, usually.

Yiyang, so you are not abused your wife refused to sponsor your greencard according to your statement. Do you have any idea as to how disgusting it sounds to the victims who went thru hell and lost their children and health? I didn't read thoroughly what you typed before. You should not seek for advise on how to scam GC.

Hello Sandranj

I really need some guidance. Yesterday I received an RFE requesting more evidence to prove battery/or extreme cruelty and good faith marriage. USCIS claims I didnt provide probative information regarding my courtship and marriage. They also claim that text message threats of deportation only show signs of martial discord and not intimidation or cruelty. If they claim it was just martial discord why would they claim I need to prove good faith marriage. The text messages clearly indicate that we were in a relationship with feelings and emotions? what exactly is probative details?

Any guidance will be appreciated.

Here my current timeline

3/10/2015 - Package mailed with I-360, I-485, I-765
03/11/2010 - Package received & signed for by INS at VSC

3/16/2015- received NOA for all apps

4/2/2015 received Prima Facie

4/11/2015 received biometric appointment for 4/20/2015

4/20/2015 Biometrics completed

5/26/2015 resubmitted I-765 using eligibility code c-9 and sent notarized letter for address change

6/2/2015 online address changed completed for I-485 and I-765

6/16/2015 received I-360 RFE notification waiting for letter

6/19/2015 received RFE for Good faith marriage and proof for battery/cruelty

Coobeans to have a VAWA case you need to prove BONAFIDE MARRIAGE and ABUSE (physical or/and mental). I agree with the officer that the threat of deportation is not extreme cruelty. The alien can mention threats of deportation to show a pattern of the abusive behavior, but if you just mentioned about the threats then you don't have a VAWA case to prove abuse.

You prove bonafide marriage showing commingling finances, sending a copy of the lease agreement in name of both, copies of car insurance, health insurance in name of both, if you don't have you need to explain why you don't have. For mental abuse is advised to have a psychological evaluation showing that you were diagnosed with depression and/or post traumatic disorder due the abuse suffered.

You spent your whole life in your home Country, how is the threat of deportation extreme cruelty? If you have a child with the abuser then the threat can be characterized as extreme cruelty, why? Because the threat to deport a mother/father would bring suffering to the alien that has to leave the child behind.

Hi everyone. Its been a while since I posted here. But I have continued reading the forum everyday. I did my I485 Interview last may 14, 2015. The interview wasn't as good as I hoped. The immigration officer was not really nice to me. Told me how come I don't go back to my own country? Or am I a muslim? Or that my country of origin has a lot of violence over there. It just wasn't a good experience

There was no decision made. I was only told that I will receive something in the mail. He didn't ask for any documents. Just really offensive questions. Until now, I did not get anything. No notifications or anything. My online status still says that my case was transferred February 9. It doesn't show that I was already scheduled for interview or I was done with my interview. I don't know what to expect. Most people I read, they get notification right after their interview or within an hour or a day.:cry::cry:

Did anyone here experience the same? Please enlighten me. I am a wreck and I needed the support of this forum group once again. Thank you so very much everyone!

Leilabird and for everyone's reference, these are the questions that were asked from me during my interview:

Where did you meet your husband? Was it an online dating site? Was he the only one you talked to?

How long did you live together? Oh wow, not even a year.

Where are you from? Isn't that place have a lot of rebels and violence going on? Are you muslim?

Who told or helped you with your I360 application? You seem to did it right without a lawyer. How did you get resources to submit application?
Who is supporting you? Your aunt? What is her job here? How long has she been here? Do you have a job? Do you have health insurance? Do you like America? its very cold here, im sure you miss your country. Why don't you go back there and be with your family and friends? *then I answered because of the nature of the abuse that I suffered. Then the officer said, that seems really bad.

Then he asked me the yes or no questions. Then he said, I cannot make a decision right now. Submit your medical results and we will make a decision and we will just mail it to the address you have here.

Then the interview was over

Most importantly how you answered to those sarcastic questions. Its obvious that the officer didn't buy your VAWA. He thought you just did it to stay here in America from the beginning.

You have my prayers. God has his own timing and plans.

Thanks leilabird. I cant remember exactly how I answered the questions. I was really nervous. All I could here was the beat of my heart. I remember my voice was shakey too cos I was really nervous. I don't know what to expect now...I have so many bad dreams that I did something or said something that made the office doubt me. What is exactly they are trying to determine on the interview. Doesn't VAWA unit adjucate proof of abuse and bonafide marriage as well? I've been reading experiences after interviews. Some people the officer asked for their I94, some were told they will receive their green card soon, etc..

NorthArcher, it is not you that did something wrong. It is the officer who either had a bad day or God knows how he sees at Domestic violence and immigrants.

Do not bang your head against the wall. It's obviously something you have no control over. You have done so much so far. Pray
