Hi VJ members...Happy Monday to you all!!

TODAY I RECEIVED AN EMAIL INFORMING ME THAT MY CASE HAS BEEN TRANSFERRED TO ANOTHER USCIS OFFICE FOR PROCESSING WHO WILL NOW HAVE JURISDICTION OVER MY CASE.

Can anyone enlighten me as to what this means for my case, thank you?

Angell 88 if your mom is sick and you can prove that then ask to.expedite your case,VAWA or l485. I asked 10 days ago to expedite a l485 that I just submitted,in 4days the case was shipped to the local office,and the interview is Friday now instead the 3/5months waiting everything was ready in less than 10days

what do need you to prove this..my dad is sick ..

Many people didnt file for divorce yet,you have to be careful with that otherwise you might have a huge problem later on. One girl that I helped with her VAWA discovered reading the newspaper that her husband published the summons to annul the marriage (based in fraud) in the newspaper,she didn't have many days left then I contested his petition and I drafted a counterclaim (11 pages) asking the judge to deny his petition,and to grant the divorce based in extreme cruelty or in alternative to grant the divorce based in irreconcilable differences.I drafted everything and she signed.

She attended the pre conference and the trial alone.I drafted two pages with the arguments that she read to the judge in her trial, and yesterday her divorce was granted, not the annulment! .Please make sure this kind of problem does not happen with you. File for divorce as soon as possible,if you can't afford to pay the Court fees you can apply to have the fees waived.

oh wow and the way am still married just because a lawyer had consulted said it's better to be married!! so can divorce then apply for vawa?

MAMAOF3 in your case USCIS made a mistake then your attorney can ask to expedite your AOS.

Read here the criteria to expedite .

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS

cridic You need to have a letter from your father's doctors stating that your father is ill, and the doctor should mention your father's diagnosis as well. Do not travel abroad if you do not have your VAWA approved,and you should not travel without advance parole.

You can file for divorce when you want,it does not affect your VAWA case if you divorce your wife now.

I have already applied for Vawa and received Prima Facie notice. I still didn't file for divorce yet. If divorce doesn't affect I-360 decision, does it affect I-485 later? Other words, if my I-360 is approved and I am divorced, will I have any problems getting green card? And also in case I-360 is denied, and I want to appeal or reapply, are there any problems if I am already divorced at that time?
