Hi everyone,

I'm joining the vawa thread too. As I wrote in my thread, I left my husband 10 days ago. My AOS is still pending, I submitted it at the end of December 2014 and in mid March I got the interview waiver letter.

When I left my husband I moved to another state and I don't think my health insurance is valid here, I have to call them in a bit, it's still too early. Without insurance, I'm not sure how I'll be able to afford a therapist for my vawa application. Any advice regarding this?

I changed my address last week and will go to an infopass appointment some time next week to make sure they updated my address.

According to sandranj's post you already have a green card. Do you have a green card?? Yes or No

Annie is advised to submit the psychological evaluation along with your form I360, you can't just submit later on without USCIS asking.They probably will issue an RFE asking proof of extreme cruelty(mental abuse) then you can submit the psychological evaluation.

Annie before you start doing therapy, make sure the professional is a PSYCHOLOGIST or therapist,not a counselor o social work,and be very clear that you need a psychological evaluation done mentioning onset of the problems/abuse in DETAILS, number of sessions, treatment recommended and diagnosis.Usually a good evaluation has 9/13 pages.I am sick and tired to read evaluations with 2/3 pages(garbage).Attend at least 5/6 session. You need to be upfront about these things with the professional, because I talked to many psychologists and they said "I charged for a simple evaluation", that being said they want to draft 2 pages and done,and of course a psychologist can't explain the abuse in 2 pages at all.

YOU DO NOT QUALIFY FOR VAWA BECAUSE YOU ARE A GREEN CARD HOLDER! You can file I-751waiver based in extreme cruelty or just in bonafide marriage.

Rejnoor I answered your two private messages on May 2015. Anyway the lawyer that informed you can file VAWA he should learn about Immigration Law,because the Law is clear about removing conditions after receiving the GC(your case).

You should leave your wife asap,she can kill you man. Because of her threats that she will hurt herself and tell the cops you battered her, I suggest you go to the police station and ask them to go to the house with you to get your belongs,get a restraining order against her,and never more return to the house or answer her emails or phone calls.

I'm currently in the process of transferring my health insurance here and then I'll find a PCP to get a referral for a psychologist. I'll make sure they know exactly what I need before we even start.

I'll wait to get the evaluation and then send the i-360. Maybe my green card will already be approved by then but that's not very likely since I received the NPIW letter in mid March.

Another question - what would be better for me and my future, to get a green card from my original i-485 application or through i-360? I'm thinking my husband probably won't withdraw the affidavit so maybe I should just try to wait this out but prepare for i-360 just in case?

Hi Sandra, I just wanted to update you and also thank you again for your help in helping me prepare my AOS paperwork. I received notification today that all has been received and the best thing ever my fees were waived. This has taken a big weight off my mind. Can you believe I still haven't got the letter yet from my mother's doctor's in the UK, but you know what I ain't stressing anymore. I think I'd rather not use the AP as I'm a bit fearful about them letting my daughter back into the country as she overstayed 10 months before I got married.

When I finally get the letter from my mum's doctor I think I may just see if they will expedite the I-485 instead as you had mentioned before.

Do you think it's easier to get them to process the AP quicker than expediting the AOS?

Angel66 I am glad Uscis waived the fees. It's easier to have the AP expedited than the AOS.Your daughter MUST NOT leave the USA without AP because she has l485 pending ,if she leaves without AP USCIS will consider her AOS abandoned.

Annie I can't advise you if it would be better to wait for GC or file VAWA ,but if you file VAWA you MUST ask USCIS to hold your l485,until final.adjudication of your l360. YOU cannot file VAWA and wait USCIS to issue your GC based in the l485 previously submitted. You need to decide if you want fo file VAWA or not. It's up to you if you want to wait the l485 decision,they may set up interview or not,if they set up they can hold your l485 or deny.

Hi Sandra, I was not intending to leave without AP. I've worked t hard to get this far to throw it all away. The stress and the tears I've endured? No I'm not that crazy LOL, but thanks for the warning. That is why I said I'd rather wait for AOS to be approved as I don't want any hiccups or problems where being allowed back in is concerned.

It's really funny and I want other readers to see this. I would say I am an educated person, I help people all the time in my line as Social Worker so I would say I'm pretty good at filling out forms and answering questions. When I was completing my AOS paperwork, I thought it was quite easy so didn't really need a professional to help me with it, I should be able to do it myself. So I completed my paperwork and Sandra kindly looked over it for me, there was some adjustments that had to be made and some little things like the wordings and making sure you follow the rules on completing the form, like putting N/A if there is a blank space.

Anyway my point is, not because you think you are competent and the forms look easy and straight forward that you think you don't need help, I'd suggest getting someone to look over it that is qualified is the best thing you can do, after all this is your life and you want as little problems as possible.

I am joining this thread as I have recently applied for Vawa as well. I am happy to find out about this forum because there are many people going through this process and share their experiences. I have found a lot of helpful information in this topic.

Here is my timeline:

April 20th 2015 - USCIS received Vawa case

April 25th 2015 - NOA sent

April 28th 2015 - Prima Facie establishment valid until October 25 2015

At this point, I am just waiting.....
