That is very concerning and not good at all. I'm still waiting for a response from my RFE. I called USCIS last week and they told me that they received the RFE but due to sensitivity of case could not give further info. I asked whether they had received the extension letter from my attorney. He couldn't answer but said everything was good with my case and that a response will be sent to the address on file.

I am very anxious now as my mother is ill and I need to return home. Don't know what to do from here. I read somewhere that the attorney can either call herself or email Vermont direct.

Angell 88 if your mom is sick and you can prove that then ask to.expedite your case,VAWA or l485. I asked 10 days ago to expedite a l485 that I just submitted,in 4days the case was shipped to the local office,and the interview is Friday now instead the 3/5months waiting everything was ready in less than 10days

Thank you Sandra. My problem as I said before my attorney seems reluctant to want to do anything. Plus I'm waiting on decision for VAWA, they would then have to send it to local office to do I485, I haven't submitted I485 yet.

Ok so I am about 2 weeks away from having my VAWA pending for 5 months. No RFE so far... I have always reveived all the letters from USCIS so far. Should I schedule an Infopass then, right when the 5 months have passed if I have no news?

Do you know if I have to re do Biometrics for the EAD and AOS. as I had to refile under VAWA?

Angel.66 :after Vawa approval the AOS is taking 4/5 months to be adjudicated,plus 1/2 months waiting for vawa unit ship the case to the NBC, if your lawyer is lazy or doesnt care about the case then set up an appointment with infopass,but without asking to expedite the AOS prepare to wait 5/6months.

MAMAOF 3 your lawyer MUST inform USCIS that you will attend interview WHERE YOU live, and not where he has his office,i dont understand why he did not inform yet. If the Lawyer doe snot inform USCIS then USCIS always assume that tge interview will be where the Lawyer office is located, because of that a good lawyer will inform that to USCIS without the client ask for.We had here in the VJ 2/3 cases like yours, the lawyers failed to inform USCIS and their files went to the attorney's State,instead where the alien lives.

My lawyer claims that since they sent my biometrics to my local office, Uscis should know to send my Aos to my local office not her uscis office. What do you suggest i do now? I also found out my case was approved in Oct not December, How do these people operate like this? so annoyed... thanks Sandra

MAMAOF3 All 3 people that had this problem, they posted in the VAWA thread,all had fingerprints where they live, and all cases USCIS shipped to where the attorneys have the offices,just if you get an AMAZING officer that pay attention that your Lawyer does not live in your State,then you might get the file in your local office.Your case was approved 6 months ago.It seems your attorney is not willing to find out what's going on with your case, then contact your congress person to find about the delay to set up your AOS interview.

One guy from VJ had a lawyer for his I485 case, but he decided to handle his daughter's case alone,no lawyer, his daughter obtained her GC as a beneficiary, guess what? the freaking officer sent to his former attorney the letter for his daughter's interview,and he was not the lawyer in the case, that being said see how organized they are.

Sandra, i guess i should ask my lawyer to call them to have it expedited because the infopass officer was very nice to me today, she wanted to help but said the case is not at my local office. my lawyer texted me saying its not her fault, but if my case is at her local office she will do infopass to find out why and i should be prepared to fly to her local office if i do not want my aos to take forever. It is well, I truly believe Gods' in control even with this silly problem. Thanks sandra

Hi Hypnos, if you are still on this forum, pls respond asap, I have been chatting with Sandra about my case, basically my case was sent to my lawyers filed office instead of mine, and after checking through old vawa chats, i came across one that you wrote. Did you have the same problem? if yes, how do i get out of this? This is for my AOS interview..thx

Yes, I had a similar problem. USCIS screwed up my case in several ways, the last of which was to send my case to the Houston local office instead of Dallas.

The only way I was able to resolve the situation was by contacting the DHS Ombudsman: https://cisomb.dhs.gov/oca/form7001.aspx

I would suggest you contact them asap. Your lawyer is mistaken if he is advising you to have your interview at his local office. Each USCIS office has jurisdiction over a set area; when they find out you are not living in their jurisdiction they will cancel the interview.

To be honest, your lawyer sounds like an idiot.

Thanks Hypnos, I really hope it's not a mess mate, I will follow your advice. she claims to have all this experience working cases, what a joke! she did not even know my case was approved in Oct, told me Dec.. I have wasted this time checking uscis website for updates and luckily did an infopass today to hear this b**l.. So upset.. Thanks though.. will make a move now.

Hi everyone,

I'm new to this topic :). After a very long struggle, and thanks to the help of a great free lawyer, I've been waiting patiently for my AOS to be approved. I feel it takes a whole lot longer in my case than it does in most cases, and I'm getting a little bit frustrated and scared, so I was very relieved when I found this forum.

As you can see in my signature below, I have been waiting for a long time for anything to happen. I can't believe it's been already two years since I sent out all my paperwork. It took a year and 3 months to get the I-360 approved and since then I've been waiting for 9 months already, still no news on the AOS.

My lawyer said it was one of the slowest cases he had...

A couple of days ago my lawyer e-mailed the NYC office to see what is happening. I was wondering if anyone has any experience with this? Does this mean I will have my interview within 60 days? This was the first time we ever requested more information, and this was their answer:

  • The A file has been requested from the Vermont Service Center. Please expect to receive additional information about your case with 60 days.

- Interview date: 24 March 2016: approved! (after 3 long years!)

- N-400 sent out: December 26, 2018
