I was approved by vawa in May 2013, summit my I485 June 2013, got my firts interview letter in October 2014 for 12/3/2014 but my paralegal forgot to call me and I miss my appointment, went to a infoopass with out knowing about my miss Interview, they call me and told me about that, give me fingerprints appointment by phone for Feb. 23, then I received a new letter for interview on March 12, everything went good she was a really nice lady who help me a lot but I need a waiver I601 for false claim citizenship in 1988 when I first come to USA, already ask Sandra a few cuestions and thank you so much for answer was very helpful, I'm still some how lost and sad, because this paralegal sucks it wasn't the first time the he made a mistake, I'm trien to look for attorney to prepare my waivernow which I don't think I can afforded, my questions are, My field office can adjudicated my waiver? Because is where I have to send it and she even told me " the longer you take to send it is the longer we are going to take to checked" the P.O box is in Chicago but field C/o office San Bernardino and she told me too, this is where they received payments but they going to send it back to her, if a get approved I'm going to get another interview? Can I applied for I191 waiver for fees?

Chabelita once the VAWA is appoved you must submit the l601 waiver to Vermont. You can ask to waive the fees.Despite your claim was BEFORE 1996 I understand you do not qualify for the waiver of admissibility,since the claim was made to an immigration officer. But find an attorney specialized in.VAWA cases to handle your waiver.

Yes Sandra I'm looking for an attorney now and I'm just tried to look my options to decided if I want to continue with this if I'm not qualify for waiver I'm just loosing my time and money, thank you so much Sandra.

Hello everyone, would you help me get an idea if there is any possibility that I can waive $1070 fee for filing forms for greencard and work permit? I already filed my VAWA petition and I received a notification via email that they will notify the result on May 11, 2015. I can't afford to pay the fees for adjustment of status.. has anyone here have successfully waived the fee? Or is it case to case basis?

Please advise!

Does anyone know how long u have to wait on a decision after i485 interview? My i360 was approved march 2014 and I filled AOS on October 7th 2014 I received interview date for march 06 2015 interview went well IO was nice lady she said everything looks good but she sees I filled some kinda T paperwork ( I have no idea what that is cause I never filed that) she says I will b fine but CNT give me a answer today she needs to do further review. My question is has anyone gone through this n how long did it take for a approval response? Sigh this process is so stressful

green eacokie you can ask to waive the I485 and I765 fees if you can't afford to pay USCIS fees,just fill out form I912.

Make sure you have a strong VAWA case before submitting form I485,because if your VAWA is denied and you have a pending I485 you will be removed from the USA.

islandgirld 59 I had some cases that the aliens got the GC 4/5 months after the interview. We have in the other VAWA thread some people waiting 3/4 months.

Are you sure you did not submit by mistake any form regarding T non immigrant status? because T forms is used by victims of Human Trafficking.

Hi sandranj thanks for responding Im not sure wat the lawyer did but I was a victim of assault n the lawyer had me submit evidence of that as well along with my vawa case but i never sent in any human traffickin form cause i was never a victim of that so could that assault document be what she was asking about because she couldn't fully explain it herself

Hi sandraj, Thanks so much for responding to my question. I do not have pending I485 yet because I filed my VAWA petition first. I know it's a little bit early to discuss about the adjustment of status since there is no result from my VAWA petition but I just want to make plan ahead of time, if ever I really have to pay the fee, then I can look for a way to prepare for that. Because I heard not all waive request will be granted, especially if there is someone who supports your expenses (I am living with my sister right now). But my sister lives from paycheck to paycheck and her income is just enough for us.

One more question, would it prolong the process of I485 if the waive request was denied? then they have to wait for the fee before they can process it right?

greencokie the fees will not be granted just if you work and your income is at or below 150 percent of the poverty level at the time you file.

Regarding what you posted ".... especially if there is someone who supports your expenses", it does not apply to VAWA filers.Household income counts for people sponsoring someone's GC, VAWA filers do not need a sponsor.

Hi Sandra, I'm still waiting on a call back from an immigration attorney. Do you think a case with cps will make a strong case for vawa? I'm afraid to file on my own.

Hi, I need some advice please, can I apply for any public assistance while waiting to file my vama application?

Also, should I try to file my application on my own? I have copies of our birth certificates or marriage license my son's birth certificate and two injure reports from my son's daycare that my husband didn't tell me about but teachers said they told him; as well as the cps report although its still open. I'm just afraid if I wait on a lawyer I will be sent deportation papers and his grandmother and bio father who are both usc will then have to get custody.
