tiger power a bunch of people contacted the congress man, and contacting the congress person does not hurt the case at all, where did you get this wrong information?.You must have your congress person involved and at the same time email the USCIS onbudsman. Usually when the case is send it back to Vermont because NBC found something wrong with your approval and then Vermont can affirm or deny your VAWA.

Thank you, Sandra. It's taking longer, than I thought. I actually ended up contacting his ex gf(he was with her when he met me) and she told me that he was emotionally abusive with her to. Using projection & manipulation. And that he was going around and telling everybody how he was gonna push me down the stairs and kill me before we ever got married. She's writing an affidavit for me as well. Every day I find something new out and just can't believe I spent over 2yrs with somebody like that...

Thanks Sandra for your post . how much longer this can take ? its there in Vermont since october 2014 and my receipt date its AUGUST 2012 ? This 2 options that's only way to find out whats happening with my case ? Thank you .

It can take as long as they want. Those are not the only 2 ways to find out what's happening, I told you: 1. infopass, 2. congressman, 3. ombudsman, you can also get a lawyer, some lawyers have special liaison with VSC, they can get information from VSC easier than we can.

Hello everyone!

Its been a while since I posted. My case was sent to a local office according to the letter that uscis sent me, They sent my i485 case to Kansas city, MO service center - February 19. I looked at the processing times in that local office and it says:

Field Office Processing Dates for Kansas City MO as of: December 31, 2014 Form Form Name Processing Timeframe

I-485 Application to Register Permanent Residence or to Adjust Status

June 27, 2014

What does this mean? How long did you guys get any interview dates since your vawa approval?

Also, I live in a different state, not Missouri,, why was my case sent to Missouri instead of the state that I lived in?

Anybody here with the same situation or experience?

My VAWA Timeline

May 5, 2014 - Filed First VAWA

September 3, 2014 - Filed I485 and I765

September 7, 2014 - Found out USCIS administratively closed my i360 because US postal service sent my RFE letter back to Vermont

October 10, 2014 - Biometrics Appointment for i485

Sent USCIS to reopen case, scheduled infopass, wrote to ombudsman

November 4, 2014 - Filed Second VAWA

December 23, 2014 - i765 Approved

January 2, 2015 - Received i765 Card

January 5, 2015 - Applied for SSN

January 12, 2015 - Approval of second Vawa

Approval of second vawa took 2 months and 12 days! No RFE. God is great!

February 9, 2015 - I-485 File is transferred to NBC

May 5,2015 - Received Interview letter for I 485

May 14, 2015 - Interview date

June 22, 2015 - Received Welcome letter and Approval letter. Will receive Green Card within 2-3 weeks

Hi there, I'm in need of some advice asap. My issue,

I came to the U.S in 2010 on a student visa, after three years in college I got married to my USC husband in may 2013, when we were courting he was very sweet and a gentle man. In august of 2014 we applied for adjustment of status did the whole biometrics. Last week Monday we got called in for an interview but it was denied because I decided to not tell my husband about the usicis letter I had gotten in the mail and just told him I had an appointment to go to, I explained what was going on to the officer viewing our case and he just said that he would have to deny because my husband/ sponsor wasn't their. He gave me a list of lawyer and thats it,

The reason I didn't want to file with my husband was because in the first week of January I was coming out of the shower when I heard my 2 and a half yr old son gagging and I heard my husband scream for him to stop, my son couldn't seem to control vomiting so my husband hit him and he started crying. I was in shocked, and I immediately came out of the bathroom to console my son, I was too shocked and scared to tell my husband anything, In the past he has given me dirty looks and gotten mad at me because I couldn't stop my son from crying. He has even told my son if he didn't stop crying that he was going to leave. My son is my husbands step son. I have spoken to a consoler at the place were my son gets for therapy and she said has advise me to leave because there are times when I went to work where my husband hadn't changed my son's diapers or feed him in the 5 hours since getting him from daycare and picking me up from work. Since that incident I don't trust him with my son at all. He has also said my son got a gab mark on his face from school when his teacher told me he didn't. Help please.

If your son is being beaten by your husband, you should leave your husband asap, the well being of your child is more important than anything. Since you are here on the vawa forum, I suspect you are considering or/and planning to file an I-360 vawa petition, correct? What do you need help with? What are your questions?

I am trying to leave but its not easy since my husband has the car. I have told my son's grandmother and she said she would help me, I started to look for a place to live and plan on moving weeks end. My son has a developmental disability this is why he gets therapy weekly so this is going to be very hard on him. I have been getting rid of stuff and my husband has seen this he now brings home a bottle of whiskey almost daily. I have also seen him up at like 5am just sitting on the sofa. How do I file? I don't want to be deported and keep Jacob away from his grandma and dads family. I have read up on vawa but I'm not sure a stepson is eligible what papers should i file?

Your stepson does qualify as long as you apply for yourself, not sure about how you add him though, but i know others on this forum that have applied with their children. you might want to look though vawa forums 3 and 4. use the search box. take care

Thanks for all you help on this page. My question is what happens if your vawa petition was approved but a letter stating that it was put in deferred action which is gonna last for 15months follows even when you spouse is an americam citizen. I applied for workpermit and got it. The work permit is to expirei in Nov. of 2015 but the 15months time line(deferred action) is to lapse by this month. Also still waiting for the response to my i485 application. Thanks

Next time you post please don't mention your son's actual name on here, just for your own security. Is your son a USC? At the interview, did you tell the officer that your husband was abusing your child? did you receive your denial letter or Notice of intent to deny yet? What country are you from?

IF your child has been abused by your USC/LPR husband then you qualify for Vawa. First thing you need to do is to get away from the abuse, I wouldn't want anything bad to happen to you or your son.

To apply for Vawa, you must complete the form I-360, with a declaration and including all supporting documentation and evidence. You then send it all to the Vermont Service Center.

These are some of the things you should include in your petition:

  • A declaration describing your relationship with the abuser and the abuse you/son suffered
  • Proof that you/son suffered abuse
  • A Psychological Evaluation if you suffered psychological abuse
  • Proof that you were in a bona fide marriage, not just in it for immigration benefits
  • Police clearance records from the past 3 years to show you are a person of "good moral character"
  • A copy of your/son passport or birth certificate
  • Proof that the abuser is a U.S. citizen or green card holder
  • Proof that you are the abuser’s spouse (Marriage Certificate)
  • Proof that you/son lived with the abuser
  • Proof that you currently live in the United States.

Look Vawa isn't the easiest to file, you have to gather many documents, it takes a lot of time, I suggest you get a lawyer to help you file it. The officers at the Vermont center are specifically trained, well trained I must add, to analyze these cases and they will deny any case that doesn't satisfy them.

Yeah my son is a USC so is biological father and grandmother. The therapist made me make a child protective service report because a few days ago i left my son with my husband and he didn't change his diaper from the time he got him from daycare to the time he picked me up from work which was 5 hours. I have put in a two weeks notice at work and now only his grandmother babysitter watches him when I'm not home. I also told the land lady in our apartment that i needed to come off the lease and she told me I need some legal document to come off,so I explain to her the urgency and she said I could fax it later. Even though we are still living together.

I'm from the english caribbean. I haven't gotten the denial notice yet but I haven't checked the mail today. I told the officer who was suppose to do our interview that my husband hit my son. He said he couldn't do anything and had to deny it, then he gave me a list of free lawyers, (only one was in my county). When i call the lawyer the day after she said that they only represent women who have been raped sexually abuse by the usc spouse.
