Hello! I am a 23 year old female. I want to start filing for a k1 visa of my boyfriend living in th philippines. I never had filed income tax before but I will be filing it for this year 2014. I wasnt able to file from the previous years because I was just a student and not working. I am an RN. Recently had a part time job just started September 2014. I earn about 2000 a month. Probably my annual income of this year would turn out to be 8 - 9 thousand. Although its a part time job, it is permanent and I am regularly scheduled to work. I am currently trying to find additional jobs to boost my income. What I do want to do however, was to see if with that income tax amounting to 8000 could I start filing for a k1 visa and show my pay stubs and maybe find a co-sponsor also? For now I know my income is not enought but I really want to try to file his visa like feb. 2015 and if I find a regular job then I can also show my possibly my pay stub? I just really want to know if this is possible than waiting for another year where I have to file income tax and meet the requirements. My co-sponsor to be would also be his uncle living here in US. Any info would greatly help! Thank you so much.

Oftentimes a joint sponsor for a K1 visa application is frowned upon at the US Embassy Manila.

If you don't meet the income requirements soonish, might as well chase a spousal visa (CR1) and file i130. You won't encounter problems using a joint sponsor with that visa category.

I found out that the spousal visa takes much longer to process than the k1 visa. Is that true? Is the marriage visa the best option?

2000 a month is well over the minimum required.

Yes I see sir. But I only started working on September. So when I file for my income tax it will only amount to 4 months worth of salary = $9000 with extra days of work. I know that amount doesnt not meet the income requirements at the present income tax but I am working permanent with my job. And I have my Boss's word that she can give me a letter to guarantee my work status. Should I just wait for another year or is this possible where I can explain my work situation and that I just recently had the job thats why my income tax wont show as much this year but I am receiving that 2000 salary every month presently. Thank you!

If you can get a letter from your current job stating your salary on company letterhead, i think that would do.

10/25: Mailed my I-129F using USPS Express to Texas Lockbox

You seem to be confusing two separate issues, paying taxes and adequate income.

I would expect you to be OK now, of course the issue will not arise for some time.

I would expect you to be OK now, of course the issue will not arise for some time.

My concern sir was that when I file my income tax of this year, it would not meet the required income for I just recently started my job. But I know that If I had been working for a few months more before I needed to file the income tax, then I could have met the poverty guideline. I wanted to know if the letter from my boss would be of help to show proof that I am earning 2000 a month. Thank you for your reply.

As stated above, $2,000 a month puts you above the minimum requirement. The fact that you didn't have a full year of earnings in 2014 isn't necessarily an issue, as current income is what matters. The confusion arises because how long you have to be working before it is treated as "current" and sustainable is somewhat subjective. The CO's discretion comes into play here. You've already got four months under your belt, and will have several more by the time your fiancé has his interview. I think you'll be fine.

For the petition phase, filing the I-129F, there is not an income requirement. Income is a requirement for the actual visa application at the embassy later. As mentioned already co-sponsors with the K-1 visa can be difficult at best, when the embassy does accept a co-sponsor with the K-1 it is usually a close relative (not sure an uncle of your fiance would make the embassy happy).

You best bet once your petition is approved would be to have a letter from your employer stating your job is permanent (even if you work short hours) and your yearly gross income, along with that keep copies of all your pay stubs. Even though you tax return (2014) will be short, a letter explaining you just completed your schooling and now working should help with that. It is possible by doing these things you will avoid the need for a co-sponsor. Working an additional job may be icing on the cake.
