I am a 19 year old currently on an E 2 visa with my family. I am in a relationship now with my girlfriend who is a US citizen coming up to a year now. We want to get married in court but not an actual wedding just yet. We have a real relationship and know each other inside and out and have proof we were actually together. But we do not live together and dont have accounts or bills that we pay since were only 19. Is any of this a problem when filing or for the marriage interview ? Please help.

The court wedding you're talking about is the actual wedding and the only one valid and recognized by the USCIS. If your plans are to get married and stay in the US you can do so and apply for your greencard.

Once you're married there will be a presumption that you'll live together and that you'll have a life together - bank account, insurance, tax forms, etc, so the fact you don't yet live together should not be an issue. If you're relationship is legit and you're not marrying with the sole intention of obtaining a greencard you should be ok.

Thank you that really helps alot. I just didnt know If the officer would ask for wedding pictures and utility bills to prove our case. But we are real and in love. So since were 19, what types of questioms would they ask and what evidence should we provide ?

As part of your process, the USCIS officer may ask for evidence of your relationship, including pictures, utility bills, tax forms, insurance policies, health insurance policies, lease contracts, etc, which are things all married couples have. It won't harm you if you don't have all of them them. In fact, since you are considering this route, start collecting evidence of your relationship.

It is safe to assume that once you're married you'll live together and commingle finance and property.

As you were told, the age is not a problem.

Ways you can prove your relationship are photos (great if family is in them too), plane tickets together, phone bills, emails etc. There is no expectation of having lived together or financial co-mingling before the marriage takes place.

Keep in mind your interview will not be immediately after you marry, it will take a few months to get the interview. And by the time the interview comes around, they WILL expect you to have joint bank accounts, live together etc.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yeah I know the interview is months after we get court married. But we are not planning to move in together or have join accounts on anything until later on when we can afford it and get a little older, so itll be after the interview. Is that still a problem ?

Because we are in love and want to get married. We were going to get married later when we were a bit older. But we decided to earlier, because we are in college. And Im currently on the E 2 visa which has no path to green card, so this way I can get married earlier to my girlfriend, so I will not age out at 21 and can go to college with a green card. Thats why.

Well as Im already in the USA, ill only need to file the AOS and dont need a fiance visa. What are some ways we could prove our relationship ? Is our young age a problem ?

The link I posted is not for a fiancé visa. It is how to adjust status when you are already in the US and married to a US citizen.

If you don't have accounts together and live together it will look like you got a marriage certificate so you could have a greencard. Don't expect an easy approval is my opinion.

Can the affidavit sponsor be one of my parents ? Or does it have to be one of hers ?

The wife must be the primary sponsor. The joint sponsor must be a US citizen or permanent resident. They do not have to be a relative.

Word of advice, don't mention this in your interview. The first thing that the IO would likely see is greencard marriage. Sounds like you have an uphill battle.

Yeah but we have a very good lawyer for a reason. My immigration lawyer is Margaret Wong. She will guide us step by step. We have no fake marriage, everything is real. So no problems, maybe after the marriage, we will have joint checking accounts and she will live in my house probably. Any problems there ?

Could the joint sponsor along with my wife, be my uncle who is a US Citizen ? Because my parents are not.
