My wife and I are in the states visiting her mom (who herself is here on a 5 year work visa). The pregnancy (twins) has now been identified as high-risk and the doctors have grounded her.

side-note: NVC process is at a bit of a standstill now while we await the police report (we weren't aware of this requirement so we didn't start the process prior to this trip to the states - now we kicked it off via the local consulate but that sounds like it is likely to take 6-8 weeks). Not sure if there is any point in sending in the AOS package now and following with the IV package down the road when the police report comes in? Or should we go ahead and submit both sans police report with an explanation and that the police report will be brought to the interview?

As for the current situation, how should we go about extending her visitor visa so that we can have a little breathing room once the babies arrive? Obviously it would be ideal if we could get the interview date established before flying back (I'd like to accompany her and the babies) to interview. Does anyone know how long things typically take to get case complete following an interview (Japan)?

Sorry for the confusion... I am the USC, my wife is here on a visitor visa, and we are visiting her mom who is here on a 5 year work visa... And yes we are at the nvc stage of our cr1 and have completed the ds-260

This sort of situation is what "AOS from tourist visa" is made for; an unexpected event occured., and you can adjust status for her to get a greeencard without having to travel back to Japan. This would probably be easier than trying to extend a visitors visa and then fly back with infant twins.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you penguin, I didn't know that was possible. Not a problem that we are already so far through cr-1?

Really you just act forget about NVC since you can't do anything there anyway and now get that I-485 together. Be sure to have copy of the NOA2 approval and izzy pizzy (well you know)

can the AOS really take years to process?

No not at all. Right now Adjustment of Status is taking about 6 to 12 months. Years. Not at all. And it has nothing to do with a K1/K3. It's for people adjusting within the country.

And as Penguin said cases like yours are what it was designed for. Adjusting from a tourist visa is good for you.
