Hello everybody,

i am trying to put together all the paperwork for my parents to be sent to the NVC. we have applied for an I-130 and got approved, just paid teh AOS fees and chose the agent. I am a bit confused by the following mention i have found regarding teh list of civil documents to be provided:

Petitioner documents:
"If you are applying for an IR5 (parent of a U.S. citizen) visa, you must obtain:
  • An original or certified copy of your petitioner’s birth certificate; and
  • An original or certified copy of your petitioner’s marriage certificate from the Petitioner’s current and all previous marriages."
My question is: do they only need the marriage certificate but NOT the divorce decree?
Secondly, we aplied for an I-130, not an IR-5 yet this kind of visa seems to be te one my parents would get?
I am a bit confused and would greatly appreciate your input, thank you!

The I-130 is a petition to establish a relationship between the petitioner and the beneficiary for visa eligibility. It supports several categories. IR-1 for example is for spouses (immediate relative category 1). Parents are category IR-5. IR-5 is the visa type they are applying for once the I-130 petition is approved.

You will need to supply all marriage certificates and divorce decrees of the petitioner as part of the civil docs for the visa application.

Civil docs and the financial docs should be submitted together in one package now and originals will need to go with the visa applicant to the interview.

From what I've seen you should be able to send the docs between paying the AOS fee and the IV fee. Once they've scanned your documents and your fees have been paid you will start the 60 day waiting period for them to review. Hopefully there will not be a checklist (no mistakes) and you'll then get case complete. At that time they will schedule the interview at the embassy depending on what slots are available.

Once you have an interview date you should schedule the medical so the embassy will have the results prior to the interview.
