SS/Medicare liability while I-485, I-765 pending

Good day everyone

My wife (USC) and I recently filed for I-130, I-485, I-765. I am currently on my F1 OPT EAD card which will expire in January. Will I be liable for SS/Medicare taxes whenever I receive my next EAD card? The company's payroll just asked me that today and I was unsure what the new status of that EAD card would list me as. As far as I know, F1s are exempted, but I do not know what classification I would be under since at that point I would be in limbo?

You'll pay your share of SS/Medicare and the employer will pay their share. 6.2% SS paid by your contributions and 6.2% paid by the employer.

Medicare is 2.9% of all your wages.

Look at it this way - want to retire in the US and use the system? Start paying for it.

I think you read my post wrong, pal. I intend to pay all taxes that I owe. Up until now, I was on an F1 OPT which is exempted. I merely would like to give the proper confirmation to my company's payroll for the next EAD card that I receive next year while pending I-485. Any suggestions?

As a LPR you will be required to pay the social security/medicare taxes. You will also be "buying in" to this system so after 40 quarters of qualified work, or sometimes less, you will be "vested" into the system and permitted to obtain benefits from it when you meet the requirements.

I don't know, but.... I'd assume that your new EAD would not be F1-OPT, and that you'd therefore be subject to the SS/Medicare taxes.

You are probably right. I would be in limbo but not in the exempted class of non resident aliens anymore. Therefore to be on the safe side, I should pay the taxes whenever I get my new EAD. Thank you.
