CR-1 or IR-1 status?

Good evening guys, I hope that everyone is enjoying their Sunday so far.. Here is a little curiosity that I have, and I would love for someone to clarify this for me. Currently, my husband, and step-daughter are under CR-1 visa category. We are thinking that if things keep moving smoothly at NVC and hopefully I don't get any more checklists, we will have our case completed by either the end of January or Febraury.. If his visa, and my step-daughter's get approved, can we wait until she finishes the school year before they immigrate to the states? Also, he will be able to collect retribution from his job. Can that be expressed to the CO at the time of interview? If that is possible, and they don't have to immigrate right away, then we will be married for over 2 years. Will they get an IR-1 visa at time of entry to the USA even if the one given at the interview was CR-1? Thank you before hand :-)

You have 6 months to enter the US after interview. Usually the time starts from day of the medical.

The only way the embassy extends a Visa is under extreme emergencies. Not because you want a 2 year or school year or bonus those would not warrant an extension.

It's the day he arrives in the US. So if he arrives after your 2 year anniversary he would get the 10 year green card n the mail.

However, don't know how much delay you are wanting. You can always after receiving your interview date get it pushed out. Most embassies will change the date twice without consequence to you (I know I did twice moved from April to July to finally September).

Hi, thank you for your answer. I do not want to delay my process more that it has been already. The only thing is that my husband and I were thinking about our little girls. His is 6 years old, and she is in the first grade. We don't know how the transition from spanish to English is going to affect her in school. If she comes here after the school year ends, she will have the entire summer to learn English. Plus, my husband's work bonus is something that we really are going to need when they get to the USA.

if you would like to extend the period of time you need to do it at the NVC. Otherwise you have 6 months from the medical date in which they can enter the USA. Set up the medical as close to the interview as possible as per the country.

Thank you NLR, I will definitely do that. It is the best choice for us on every level. We were thinking that it will also save us money. I am not sure of the fees for lifting conditions, but in our case we will have to pay twice, right? His green card and her as well. Anyways, God willing everything is going to workout okay.
