K-1 Visa Expiring in January

The k-1 visa is valid for the time listed on it, meaning your husband has until that date to initially enter the US and get married. It expired when he arrived in the US to get married. His AOS should have been filed, however, before his I-94 expired which is 90 days post-entry.

My hubby K-1 Visa will be expiring very soon. Therefore making his visa invalid. We have already filed for AOS.

Does he need to apply for any visa extension while the AOS is in process?

Hi it's his I-94 that is due to expire as the K-1 visa expired the day he entered the USA, as you have sent off the AOS he is now in a new period of authorized stay & will be until it is all sorted out.

April 14th 2017  I-551 stamp in passport 

April 27th 2017 Received text & email Card/Document Production

May 3rd 2017 Received 10 year Green Card today   

N-400

March 7th 2017 N-400 sent to Dallas TX 

March 10th N-400 Application received

March 15th Cheque for $725 cashed

March 20th received NOA1 dated March 15th

March 24th received biometrics appointment for 04/05/17

March 28th did early walk in for biometrics 

October 10th received Citizenship Interview letter

November 13th Citizenship Interview at 10 am Mount Laurel NJ passed my interview.

November 13th Oath ceremony 3pm now a citizen

November 14th applied for my passport 

November 25th Received my passport 

November 27th Received my naturalization certificate back

November 28th Updated my social security records

Thanks alot..

The i-94 expires end of this month. He is in the country, Married, and AOS filed

So i guess nothing needs to filed for any extensin.

Ideal, but not required. There is no deadline to file for AOS, however, the sooner one files, the sooner one will be able to receive an EAD work authorization, and Permanent Residence card, which will start the clock toward the three years that must pass before filing for citizenship. There are certain risks for not filing within a few months after marriage, mainly travel risks. Other than that, no worries, file as soon as you have the means to do so.
