Timeline

Hello! I'm going to be applying for my husband's visa from London as we are both living here. I've got an email from a former employer stating the work he can give me as soon as I return to the USA, and I am going to ask him to write a formal letter stating this and my sister to write a formal letter stating that me and my husband will be living with her when we return. I am going to use these in my application and hope this is enough evidence that the USA will accept that I have a job and an abode when we return, for the Affadavit of Support. My question is, if these are not accepted, will I have to re-apply, start the entire process over and pay again once I return to the States and have more evidence of a domicile and employment in the States? Or will I be able to amend my current application with further evidence? I don't want to do it if I'll have to start completely over if the evidence is rejected; instead I'll wait till I'm in the USA and then send in the evidence. Many thanks for your help! :)

It will depend how the case is adjudicated. If they request more evidence, you will have a period within which to supply any information requested. If the case is denied and returned to the USCIS, you have two choices: 1) Begin the appeal process or 2) Start again with a new petition.

If LONDON finds anything more they want from you, they tell you what it is. When you provide that, they continue with the visa issuance. You will send the requested documentation to the Immigrant Visa Unit. There won't be another interview required. The intent to domicile issue is very easy in London.

Timeline

I-130 petition? not needed for the DCF'd submittal into London USCIS office.

I-864 intake for London IV - in the instructions - there's a split/fork on the path that you should choose - and I'll repeat it, paraphrase here.

Pick 1 path:

1. Proof to steps taken to re-establish USA Domicile or

2. Proof of USA Domicile.

The proof you want to amass, I think, goes in with #1. Unless you've a house in the USA where the title/deed is in your name.

Since yer doing DCF into London - all of the AOS/I-864 stuff is compiled/reviewed/adjudicated at the IV Unit there in London, USUALLY around the date of interview. If problems with it, a Vice-Consul will tell the beneficiary about it on Interview Day, and not before.
