Hey guys,

I finally arrived in the US with my K1 visa after 9 months of waiting time.

Now, I have a question for the work permit under K1 visa. I have to fill out the form I-765, 2 passport pics, and I have to send in evidence of the fiance visa status.

What kind of evidence do they need:

- copy of my passport stamp and the visa

- approval such as NOA2

- I-94?! I do not have the 1-94, only the stamp in my passport with the date how long the visa is valid.

Do you have some experience with the application for work permit under K1?

yeah I know, but I want and need to work before I get the greencard. I have already a ssn which I got when I worked with my student visa in the US, it says "allowed to work with DHS authorization". I guess that needs to be changed after I got work permit.

It can take 90 days for your EAD card to arrive, and it's only valid as long as the I-94 is valid (90 days). It's really not worth doing until you're married. If you need to start work ASAP, you can do a courthouse marriage, send in all the paperwork, and then do the wedding ceremony later.

May 31: Biometrics appointment scheduled

June 1: Biometrics appointment letter arrives!

I read this before, it makes applying for a work permit prior getting married worthless

Permission to Work
After admission, your fiancé(e) may immediately apply for permission to work by filing a Form I-765, Application for Employment Authorization with the USCIS Service Center having jurisdiction over your place of residence. Any work authorization based on a nonimmigrant fiancé (e) visa would be valid for only 90 days after entry. However, your fiancé (e) would also be eligible to apply for an extended work authorization at the same time as he or she files for permanent residence. In this case, your fiancé(e) would file Form I-765 together with Form I-485 as soon as you marry.







I-765 processing can take upto 90 days. By the time you get your EAD, it'll only be valid by either a few days. Better to file for EAD when you submit your I-485.

Its cheaper to file the ead with the AOS too. Dont waste your money.

The i-94 is now found online.

You have to pay for work permit under K-1, and it expires when your I-94 expires. Here is where you find your I-94.

With the EAD/AP it is free with AOS, and is good for one year.

Both take 3 months to process.

Your SSN statement will not change until u get GC.

You are no longer under a student Visa but a K-1 Visa. You must File the appropriate paper for EAD.. Your student Visa is VOID/INVALID

Typically, when a person enters the USA with a K-1 visa, s/he gets married within 90 days, and then files for AOS, EAD and AP at the same time. After filing for thee items the person may get the EAD as early as 10 weeks after filing, but depending on the work centers workload it may take longer. Just my opinion, but doing it any other way can be very expensive, not work, and if it does work the EAD may not be valid for very long.
