I posted this questions before, I think one year ago. I am going back to the Philippines next year. I have a cousin who got pregnant from her American live in partner and they separate. They have a child and he is American Citizen and have an American passport. Since my cousin has no job and the American father gave support 500 to 1000 sometime a month sometimes not. So, my cousin decided to ask me if I can bring the child here in US and live with me and I will take care of everything. My cousin also told me that her Ex live in partner is ok with it, which he is living now in the Philippines for good. Is it legal for me to take my nephew here in US? If it is what kind of papers do I need to fill out?

First, they both will have to give you temporary custody, without that documentation, you will not be able to do anything legally for the child including obtaining medical care, enrolling in school, etc...

If the child is a US citizen, there is no paperwork needed for the child to enter the country, other than proof that you have temporary custody from both parents, possibly birth certificate.

If the child is a US citizen, there is no paperwork needed for the child to enter the country, other than proof that you have temporary custody from both parents, possibly birth certificate.

 

What type of papers do I need to become a temporary custody?

I just talked to my cousin and she talked to her X, and he told my cousin alot of paper works to do. For me it feels like he dont want me to take care of his son. I want to give a good future of his son while he is not doing his responsiblities as a father. Is it possible that my cousin will only sign the temporary custody, since he is not around.

A good attorney would do the paper work for about 300.00.,.,. and have it notarized, and make "certified" copies, for all parties.

You keep the "original" and use the certified copies, for the process.

It is just my recommendation.
