K1 - Provided annulment finality only. Will I get an RFE?

Timeline

Hi, my fiance's annulment finished 2 months ago. At the time, I was advised by some people here at VJ that the Certificate of Finality was all I needed to start the K1 process, so I went ahead and filed with that. We are currently waiting on our NOA2. In the meantime, my fiance is handling the NSO process in Quezon City, her annotated MC is scheduled to be released on Jan 12, and we were told that we could get our CEMAR about 1 week after that.

I came across a few posts here where people received an RFE because USCIS also wanted a copy of the annotated MC and CEMAR... so now I'm worried. Did I file too early? Is there a chance that maybe I won't get an RFE? Has anyone here on VJ only provided a Finality and NOT receive an RFE?

I have a feeling that luck is also a big part of this, that it depends on the USCIS adjudicator... If the official is having a good day, they might let it pass, as long as we bring the complete annulment docs to the interview. But if the official is strict, I'll get an RFE.

I realize there's no point in asking, I just have to wait and see what happens. But I just wanted to hear your thoughts on this, because you guys are awesome ;) Thanks!

01-23-2015: USCIS status: Case was Approved

01-30-2015: NOA2 hard copy

02-02-2015: USCIS sent K1 package to NVC

02-10-2015: NVC received K1 package

02-11-2015: Date that NVC supposedly assigned case number

02-18-2015: Called NVC and asked for case number

02-23-2015: Paid MRV Fee

03-02-2015: Scheduled USEM interview appointment

03-02-2015: NVC letter received

03-09-2015: Medical interview

04-23-2015: USEM interview, got 221g email, CEAC status: Immigrant AP

04-28-2015: CFO Seminar, sent 221g response

04-29-2015: USEM received 221g response

04-30-2015: CEAC status date updated

06-17-2015: CEAC status: Non-Immigrant Ready

06-27-2015: CEAC status: Non-Immigrant AP

07-01-2015: Visa in hand! (CEAC still AP lol)

We filed with out the annotated MC and had no problems. By the time they send you an RFE, not saying they will, but if they do it's just a matter to send the annotated MC when you have it later in January. Should only set you back a week or two in processing time. I wouldn't worry about it. Keep gathering all your other documents and getting ready for the interview.

We also filed only with Certificate of Finality and no problem. At the interview you will need the annotated MC and a fresh CENOMAR.

Your over thinking this. You will need the annotated MC and a fresh CENOMAR. That's it. Do only what do will do.

We did receive an RFE because we sent the annulment paperwork but did not include the actual court signed documents with all of the background.  We had to send the court paperwork that included the judges signature.  The annotated MC was not enough for us.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
