Hi there,

My wife and I are currently finishing off the AOS paperwork and we have a question regarding the proofs for the i-864 (affidavit of support) - since we are within the time frame for sending it in (within 90 days of my arrival into the country) and only submitted our first affidavit of support a few months ago in August, can we use the same proof we originally submitted? Obviously we will have to fill out, sign and date a new i-864 form but again, can we otherwise use the exact same proof as it is relatively current?

First of all, you are required to get married within 90 days of your arrival, not AOS.

Secondly, did you mean the Affidavit of Support you gave it to your fiance when he/she took the K1 interview? If yes, I believe it was I-134. And it is not suitable for AOSing. Your need I-864 to meet 125% of poverty guideline. If it was an I-864, then you can use it with all current supporting documents (W2s, pay check, employer letter...) But please keep in mind that by the time of the interview (After April 2015, if any) you will need a new I-864 with new tax info for 2014 income. Good luck.

Right, I was confusing the I-864 with the I-134 due to the fact that it looks as if they require the same information? But if I can use the same supporting documents then you've answered my question and thank you. One more though - considering I used a co-sponsor with my I-134, I had to fill in 2 copies of that even though I didn't meet the requirements at all. Will I have to do the same thing with the I-864 as I am still using the same co-sponsor?

Yes you do same thing with I-864 (2 of them, even you make nothing), and please make sure you and co-sponsor meet 125% poverty guideline with current income proofs. Google I-864P for your reference.

Thank you for all your help, I get it now. I think I've gone brain dead from all this paperwork!

Just a concern here; How did the overall interview go before the visa was granted since you used a co-sponsor? Kind of off topic here but if it's OK with you I could PM

Yes, you can use the same proof, as proof is proof, of you marriage, and show you are happily married and have joint finical holdings.
