Hello Everyone,

I have been going through my immigration process.

I got fingerprinted last week (12-15-2014) and was waiting for my work permit, the next step, when i got a yellow letter in the mail.

it says:

Request for initial Evidence (1-485)

this office sis unable to complete the processing of your application to Register Permanent Residence or Adjust status without initial information

1. Submit all supporting tax documentation (w2-, 1099s, Form 2555 and all supporting tax schedules) submitted to the IRS for the most recent tax year)

2. Based on the documents submitted with form I-864, Affidavit of Support. for the petitioner/sponsor. the income did not meet 125% (100% if military) of the poverty guideline for the petitioner/sponsor's household size.

submit evidence of assets that meet the standards listed below to obtain joint sponsor.

We submitted my partners taxes for the last 3 years and we meet the requirements. what should we do?

Did you send them complete 100% copies of the tax returns, including all forms and schedules? Or complete tax transcripts?

Day 341 (12/10/18) Interview was scheduled for 1/14/19

Day 376 (1/14/19) Interview

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX

Forget copies of the tax return. Goto the IRS website and order tax TRANSCIPTS. That is a complete tax return as filed and processed by the IRS and very hard to fake. The USCIS accepts tax TRANSCRIPTS, but may want copies of the W-2 or 1099 or Schedule A for them to consider it a complete tax return. With electronic filing it is hard to know what a complete tax return is these days. It used to be send in a copy of what you sent to the IRS. Too many RFEs have been given for incomplete tax returns when this is easy to solve by getting copies of your tax transcripts--they are free and very easy to obtain.

Just the USC petitioner/sponsor that fills out the I-864. Provide the most recent transcript they are asking for, and if they are not self-employed, then provide a letter from employer and/or recent pay stubs too. Those will help prove your income meets the requirement.

To clarify, I work here legally, at the same job and with an H1b.

My partner will be sponsoring me but might not meet the income requirements on his own. can I, the intending immigrant, include my income for the past 3 years on form i-864 as our household income in addition to his? if so, do i need to send my tax documentation too?

Google self-petition, it is difficult to prove your income will come from same source (your job) after you submit I-864. If you can prove that, yes you need all your tax document.

Did you send your husbands current paystubs proving his current income as well as tax transcripts? This is the number 1 reason people on visa journey get an RFE even though they're sure they meet 125% of the poverty guidelines.

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

07-11-2022: Naturalization Interview

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, you can add your income on your spouse's I-864. You will need to provide proof that your job will continue after you become a permanent resident. You can provide a letter from employer that states your job is permanent and will continue after you obtain permanent residence status in the US. You will need to provide proof of your income, which could also be included in the employment letter about your job continuing. Provide a copy of your most recent tax transcript as well.

Update. I sent back a letter from my employer my tax information, my partners tax information from the last 2 years and bank statements from the last year.

i hope everything is alright.

Nothing Yet, a friend of mine got married around the same time I did, he called to see if he could get some information and they said they are experiencing a heavy load of traffic this time of year. and just to be patient.
