OPTIONS TO TRIGGER ADJUDICATION OF PENDING I-751

HI ,CAN ANYONE share their experience as to the options we can follow to trigger dormant,pendign 751.My case has been pending more than 2 years.

Should I apply for N-400 (my 5 years are over ) OR just keep waiting on I-751.Everytime I enquire they send me a notice to wait for 90 days...now it is the 3 rd time I got this notice form USCIS.Thanks

Thanks for the reply.I do have plans.

I asked this question to a lawyer and he said it will be wastage of money to file a new petition.USCIS will not do anything until 751 is approved.He said instead i should pay him $ 500 and he can get me the update as to why my case is taking so long....It confuses me ,does USCIS will give the lawyers the information as to what is the real reason for the delay of a particular case.

This is the same as if I were to tell you to give me $500 and I will get information from the USCIS. The lawyer may have someone on the inside, but I doubt it. Your congress critter is the best to see what is going on with the I-751 petion. Filing the N-400 will force them to make a decision on your ROC before you receive your USC. Save the $500 you would pay the lawyer and apply it towards teh N-400 application.

I have been going throught something very similar. My I-751 has been delayed for almost two years.

I waited and thought it would run its course and that we will eventually get a reply. That never happened. So we went ahead and made several phone calls to USCIS customer service and spoke to a tier-2 person. Each time they said it was waiting for the interview. The interesting thing is that my case online was never updated. Anyway, we eventaully made an infopass appointment and went into the local office and they they said the case was not a priority and they had other cases to adjuciate that required immediate attention. We again waitied but with 6 more months having gone past with no update, we had our congressman write in and demand an explanation. His office was told that there was a large backlog and they are working on those. Two months later we hired an attorney and he suggested we check in for the reason first (whom we paid $500) and all he did was go in and make the same infopass appointment that we did. that was a complete waste of money and from our experience I dont recommend that at all.

We got a new attorney who told us to file the N-400 as that will force them to work on your I-751. Its been a few months and we are still waiting.

That was the reason I was reluctant to pay $500 to the lawyer.I also have waited for long now .Every time I get a notice to wait for 90 days from the last 9 months.My plan is to make infopass appoitment and ask them that I want to talk to the supervisior( BUT I AM NOT SURE IF THEY WILL ENTERTAIN AND IF IT WOULD BE HELPFUL )

And after that I will apply for N400 in January 2015 and then we will see what happens.

did u file jointly or seperatly ?

In my case is everything is separate.I filed divorce before filling 751.So it was under god faith marriage.And now N 400 will also be separate (5 years time)

Just now I got the infopass appointment for January 7th 2014 for Los Angeles Office after a wait for almost 1 month.I use to check everyday if the appointments were open and at last I got it.!

Lets see what supervisor has to say as to the cause of the delay in processing my 751.But I can predict right now that he or she will not tell ne anything more than That my case is pending consideration.I will keep everybody updated.

My case status never got updated since they received my 751 petition that was in October of 2011, although I had my Biometrics and Interview done in 2012. !!!

I would complete the N-400 application and have all supporting documents and a check for the fee and hand that to the supervisor at your INFOpass appointment. If they do not accept it then inform them that you are going to mail it as soon as you leave the office. Make certain you keep copies if they accept it and get a receipt o fthem accepting the N-400 application. I get they will not accept it, but I also bet your I-751 gets pulled for processing as they know an N-400 will be coming and the I-751 needs to be approved.

do not give a lawyer $500, because any information he receives you should be able to get yourself. If he does obtain any information, it will be through unofficial channels, and therefore would be useless to you in formal proceedings.
