Not revealing he has a son here, then a cousin sends an invitation letter raised a red flag

That's in their computer and he signed that app. so that stands, retiring and helping a

friend can be explained, but omitting a child in the US will not get him a visa, apply

for citizenship and after petition him, also mom has a visa, these applications are checked

out B4 you even get an appt. date at embassy, the COs mind are about 70 % made up

then one goes in and prove they will return home ,

Hey Jawaree,

Thanks for your input. His application was filled out by someone else. I am aware of the fact that We made some mistakes as far as application form and interview is concerned. That's why I am here to seek advice from VJ members. My mom went back to her homeland after visiting me in November. Do you think showing her visa and proving that she went back after visiting me in US could help my Father's application for visa?

If he did not mention you he lied.

I appreciate your invaluable input. It was very helpful.

Form you mentioned typically requires to list location of your relatives and that form is signed by him.

So how did he exactly answer the question on the location of his family ?

Hi Kzielu,

Thanks for your response. I think he mentioned he will be visiting family friends. I just need advice on how to tackle the whole process the second time.

Very bad idea to not be truthful on the application because it could lead to a permanent denial including the ability to ever become an LPR. Lying by omission is considered lying for these purposes. It's good that at least he told the truth to the CO, but everything said to the CO should coincide with the application.

Also letters of invitation are of no help whatsoever, this cannot be stressed enough around VJ. On the contrary, they often times do more harm than good because the applicant has to prove their own ties and assure the CO that they are not an intending immigrant. If letters of invitation were of any help, more people would be approved.

Hi IAN,

Thanks for your response. I just need some advice on how to tackle the whole process the second time.

Exactly.

If he didn't mention the you in his visa application and then mentioned you at the interview, he lied.

It will be hard to overcome.

Hi Asia,

thanks or your invaluable input.

But in the visa application you're being asked not only who are you visiting/what's the purpose of your travel to the US, but if you have any immediate family (spouse/fiance/fiancee/child/sibling) in the US.

Can't give you any advice, I am actually surprised he didn't get flagged for misrepresentation. I think reapplying in this case would be waste of money.

It may not be a good idea to apply again especially if nothing has really changed since the last application, or has it? If you have the filing fee to spare then go ahead if you want, but you have to make sure to answer the application honestly and completely. If it asks for something you cannot omit it.

This does not constitute legal advice.

Might be noted on his file but it seems that they do not bring out the big guns unless needed. My guess is that a simple refusal is easier.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

The only 2 questions from the officer had to do with exactly the things he was not honest about. Relatives and employment.

I dont see why you asked him to lie about those two things when the job could have actually helped prove he has some ties and something to come back to.

Also, if I recall correctly, there is a question on the application (Do you have any relatives living in the US that can petition for you)... if he did not mention that you were there, then he lied... and he is lucky that they let him get away with that.

Question for you.. are the reasons you listed the exact basis for his ineligibility? Did they give him a code or actually mentioned that?

I would say wait a few months and then reapply telling the truth.

That actually helped MY own tourist visa application the first time around. I shown both my brother and sister-in-law visas. I said I would be travelling with them and that they would be paying for the trip (I was still in college at the time and they were 10 yrs my seniors with high paying medical jobs).

Hi All,

I keep seeing few people telling me that he lied, he should have not said this etc etc. I know people that it was a mistake on our part. I am here to seek advice and not a decision on our case. Leave that for the visa officer. Most of the people on this post gave a sincere advice but a minority of them gave me a one liner '...he lied'.

If you have no advice to give then I'd appreciate if you refrain from posting one liners.

Thanks

Thanks a lot. Any advice you could give on how I should approach the process this time around?

well he got denied in July. So we are intending on applying early next year. I am not sure how to rectify the mistake that was made during the first time. Any advice is highly appreciated.

so I guess there is absolutely no chance of him getting the visa. I suppose there is no way out?

Never say never, he can only try.

Heu,

Thanks for your response. My father does not have any bank balance but he does own property. So I suppose the best thing would be for me to send him the invitation and in the application he should mention me as being responsible for all his expenses since his monthly income is very low. I have a good job and I can send all my salary slips etc. What would you suggest?

By the way my father's visa got denied in July this year.

Thanks

Isn't there a question on the visa application that asks for relatives in the US? What did your father write for that question?

Difficult to gain that trust back

good luck

Hey,

Thanks for your response. I think he mentioned about his family here in US. Someone else was helping him with the visa application. Could you please advise on how we should go about doing the application for and interview this time around. I am planning on sending him the invitation. He owns property, would that be of any help?

Thanks in advance

Anything with respect to you is irrelevant. The consular officer will put little to no weight on your pay stubs, your ability to pay for him, your invitation. I suggest your father fills out the application (although you may assist) and your father submits all that he can to show that he must return. Has he traveled to any other countries?

good luck
