Hello,

I got my fiancee here from Ukraine with major help from the gang here at VJ---But--- I feel like a real newbie all over again now that I'm on a new phase of the Journey.

I'm looking to get a SS# for fiancee but am unsure about some things on the form----- is there a nice thread that already covers this that someone can direct me to?

What the heck is an "EAD" ??

(PS--- some of my SS-5 questions are: Question #3----- being a K-1 holder which of these work status's does she fall under---- "legal alien allowed to work" ?

#10 "has the applicant or anyone acting on his behalf..." being the filer of the K-1 petition haven't I "acted on her behalf"--?? ) etc

An individual with K-1/2/3/4 status applying for a work authorized SSN must present evidence at an SSA office to establish his or her age, identity and current lawful employment authorized status.

Note: Checking off on the DS-230 to be assigned an SSN DOES NOT aaply for individuals issued K visas. That is only for individuals age 18 or older that have been issued an immigrant visa and all K visa classifications are non immigrant.

The applicant needs to provide at least two documents as evidence to establish age, identity and current lawful employment authorized status. If one document is used for identity and employment authorized, another has to be provided for age.

SSA will not assign an SSN or issue a card to an individual that is within 14 days of his or her alien status expiring. Until the 76th day after entry an individual with K-1 status only needs to provide an unexpired I-94 showing current K-1 status to establish employment authorized status for SSN purposes.

Once, an individual that entered the United States with K-1 status has been in the United States 76 days he or she will need another document, i.e. I-551, I-688B or I-766 to establish employment authorized status for SSN purposes.

EAD=Employment Authorisation Document...this enables your wife to work and is a seperate application to the Adjustment of Status..

your wife is under the catagory of not legally able to work (although she is within the first 90 days of her getting here but she would have to stop when her I-94 expires)

Q3. If you check "Legal Alien Not Allowed to Work," you must provide a document from a U.S.

Federal, State, or local government agency that explains why you need a Social Security number

and that you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S.

State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your

reason qualifies.

If you check "Other," you must provide a document from the U.S. government agency that

explains why you need a Social Security number and that you meet all of the requirements for a

Federal benefit except for the number.

Q 10...Has the applicant or anyone acting on his/her behalf ever filed for or received a Social Security

number card before?

Yes (If "yes", answer questions 11-13.) No (If "no," go on to question 14.)

the above number 10 is for a social security card not for the K1 visa application... so your answer would be NO...

dont forget to take in all the identification she has with her ..marriage cert..birth cert..passport with the I-94 stapled in it..

REMOVING CONDITIONS

11th Aug 2008 - Mailed I-751 to CSC.

12th Aug 2008 - Application received

14th Aug 2008 - Cheque cashed

18th Aug 2008 - Received NOA-dated the 12th

26th Aug 2008 - Received Biometrics letter

4th Sept 2008 - Biometrics-Detroit-Complete-'Touched'

5th Sept 2008 - 'Touched'

1st Dec 2008 - APPROVED-Card production ordered -112 days

8th Dec 2008 - USCIS mailed approval notice.

8th Dec 2008 - Received my 10 year Greencard in the mail. took 2 days.

Although I have the above date for approval my card actualy states the

2nd December..

Johnnysc has not given us the information needed to know whether his fiancee is employment authorized or not. But if she is within the 90 day stay that the I-94 allows her then she is in the category of 'legal alien allowed to work' until, as you point out, those 90 days are up.
