Petition denied - problem with G325A forms

On October 10th, I was sent an RFE to submit "properly filed out and signed G325As" my myself and the beneficiary. There was no indication what was wrong with the original G325As which I submitted, but after reading them over and over again, I found two errors:

1) In the "form is submitted in connection with an application for" section, we wrote "K-1 Visa" rather than "I-129F" - that doesn't seem serious, but I can see a strict adjudicator not liking it.

2) In the bottom box which asks for family name, first name, middle name, we accidentally wrote my fiance's name in Cyrillic letters.

I corrected these two mistakes and sent in these new G325As. They received them on October 10th.

My denial letter, which I just received, states the following:

"The petitioner responded to our request on October 30th, and submitted an additional copy of the Form G325 already submitted for the petitioner and the beneficiary. However, he did not submit the required Form(s) G-325A as requested.

The petitioner has not complied with the instructions on the forms by submitting the required evidence. Therefore, the petition is denied."

I note their lack of consistency - is it a G325A or G325 form?

The appeal process appears to cost $630. This is quite obviously their mistake, I'm going to refrain from some editorializing about the irony of them insisting on absolute accuracy when they don't seem to pay attention to details either.

Suggestions? Refile? Have a good lawyer look over the application first? At last check, my state still goes through CSC, which is moving relatively quickly, I have to think refiling is not only cheaper, but faster.

I looked this up - there is a G325 and a G325A. They are distinct forms, I did submit a G325. But, the forms, as far as I can tell, are identical. Help!

It is good that you finally know why the denial yay!

You were incorrect, you sent the wrong form.

It's the G325A you submit. Not the G325 as you just found out you sent.

I advise just to refile. You made a mistake, they asked for what the needed and you sent the wrong form.

They are fully in their right to deny, nothing to be done.

Csc does usually move fast but every case is different remember that.

Edit: forgot to mention as to why. The G325 has only 2 copies.

The G325A has 4.

This is why you submit the G325A

Yeah, I looked over the RFE they sent. Please shoot me. Still, it pisses me off that the forms ask for identical information in identical order (there is a merging of some fields, but there's no way to misunderstand the data).

I think I will just refile. Hopefully my fiance doesn't mind the fact that she is marrying an idiot who can't read carefully. :)

With all RFE posts I always say one very important thing!

This is the only mistake you made.

And it was tiny, really stupidly tiny!

They were looking at your file and just just had a shorter form instead of the longer one.

When it's something like this it seems to always be an approval.

So refile, don't fret!

I put the wrong email on the notification sheet and my now husband was so annoyed!

So at least you know it's tiny :)

4 vs 2? From the I-129F instructions:

Submit two completed and signed Forms G-325A, Biographic Information; one for you and one for your

beneficiary. Except for name and signature, you do not have to repeat the information given on your Form I-129

I will have to update my multiple filing waiver request, but that should be straightforward enough, especially as I'll be pointing out petition #3 was screwed up by me and that the new one is for the same beneficiary (patiently waiting for her idiot fiance to get the paperwork filed :)).

okay, now i'm worried. i haven't submitted yet, but where does it say there's 2 vs. 4 copies? i only have one copy (1 from my fiance and 1 from myself equaling 2 pieces of paper) in my tentative packet.

plus, i just googled and downloaded both documents to compare, and they are IDENTICAL--down to the date--so i'm not sure what to use now.

...however, i'm glad i didn't send it off yet before reading this!

December 31, 2014/6pm: paid & checked in I-129F at FedEx/Kinko's; they said it should reach TSC by 2Jan15
June 26, 2015/9pm: received text/email that I-129F was approved--took 5 months/2 weeks/3 days

7Jan15: received notification via email and text of receipt at TSC
9Jan15: date of receipt on official NOA1 I-797 form that was mailed back from TSC
26Jun15/9pm: received text/email that I-129F was approved--took 5 months/2 weeks/3 days
3Jul15: received official NOA2 approval letter that said it was sent to NVC on 2Jul15

10Jul15: NVC received, created case number, and put into their system (at least that's what i was told on 17Jul15)
called NVC on July 17, 24 and will call Aug 7--STILL IN Administrative Processing
4Aug15 - checked CEAC site; finally "In Transit" (!!!)
7Aug15 - CEAC site says "Ready at Embassy (BGN)"
7Aug15 - 1st phone contact with BGN, was told everything is by email now, no phone calls are conducted :sleepy:
10Aug15 - 1st email contact with BGN--several auto responses, the American Consulate Service email address is the only one to reply after i sent screenshot of CEAC "Ready" page, saying they haven't received anything from NVC but that they sent Packet 3

11Aug15 - 2nd email contact with BGN--BridgetownACS replies the next day, ADMITTING that they sent Packet 3 via r-e-g-u-l-a-r INTERNATIONAL snail mail--not DHL--and attaches .pdf of Packet 3 :ranting:

12Aug15 - 3rd email contact with BGN
13Aug15 - BGN won't respond to 12Aug15 email; resent email asking for help with my 3 questions on how to proceed since they don't/won't answer questions via phone; signed Visa Interview Request letter DHLed to BGN
14Aug15 BGN received DHL visa interview request letter at 3pm...radio silence
4am 17aug15 - emailed embassy with .pdf proof of 14aug15 BGN receipt of signed interview request letter and made request for an interview date and time
9am 17aug15 - embassy emailed back with .pdf of packet 4 AND letter granting interview date and time! :wow:
official papers STILL on their way via INTERNATIONAL SNAIL MAIL though... :rolleyes:
4sep15 BGN confirms, via email, that the .pdf versions of Packet 3 & 4 they sent will be viable for use at the BGN interview and medicals
7-11sep15 - paper packet 4 arrived in DOM via international snail mail from BGN **AFTER** TS Erika came through (paper packet 3 is probably lost in the ether somewhere, lol)
22sep15 - interview AND APPROVAL at BGN!
5OCT15 - VISA IN PASSPORT & IN HAND VIA DHL!!!! :dance:

By 4 I mean 4 pages.

It's still only one form each but the g325a is longer slightly.

It is the G325A for a k1.

Don't think otherwise :)

Cody and Daisy - both forms are 2 pages. They are almost identical (the typesetting differs ever so slightly), the only difference in data fields is that date and place of termination of marriage are merged into a single field in the G325A. I believe there was an older G325A which was several pages, but it is no longer the case.

When we filed the 129f,we used g325 form,now we filed the AOS we used the G325A..its identical but maybe it has their own used..goodluck

Oh it's weird, must have changed.

I've never actually heard of anyone on here using a G325 for a k1. Until the person above me.

It's always been a G325A, so just in case I'd stick with it.

Refile and use the G-325A for each of you. I have seen people get an RFE for using the G-325 instead. The forms are pretty much the same, but the I-129F instructions call for using the G-325A, so that is the form you must use.

I am sure some people have gotten by with the G-325, but that is not the correct form in this case.

And just to clear this up: The G-325A does not have more pages than the G-325. They are both one page forms. When you download either form, you will have 2 pages total, one is the form and the other is just the instructions, which are pretty much pointless.
