Hi,

She didn't mean that the AP represents a denial. She is talking about two different subjects. Yeah, we need to focus on the positive but also discussing about the latest information here (Which includes denials, AP and etc) to avoid every possible reason to get stuck in AP or even denial is also valid. I know we're all excited/stressed/scared at this point but in MY opinion we need to bring in here any kind of valid info to be prepared as much as we can.

You're probably right, she didn't mean to say that AP is denial but she said the couple was denied because they need to provide more evidence of domicile. That's not denial. A denial is a full out rejection when goodness forbid someone is told a flat no.

Hehehe, I guess we're a little bit crazy about this process, lol!!! :) She mentioned that the couple were put in AP because they need more proofs of his domicile. The thingis that the USC has been living in Poland for more than three years (He created a forum as well) and the Embassy wants more evidences that he really intends to go back to the U.S and I hope he makes to prove them whatever they want to be shown!!

That's the sentence: Last week one Polish girl went to the embassy with his fiance (5 years together) and they were being put in AP. They need more proof of his domicile in the US.

It seems like they send them out after a few days to a week. Depending when you got approved and when the next shipment is. Also it takes a while to get to NVC and for some it takes a while before they process it and send it off to the embassy. And then sometimes there might be hold ups with the embassy. So if all goes smoothly for you, March 21st sounds reasonable. I'm hoping for a March wedding also :)

Congratulations Ko Zaw,

For me, mine was approved on Oct 29th. NVC processed my paperwork on Nov 20th. By Nov 24th, US Embassy in Yangon had already typed up their instructional sheet (found out that later on). I e-mailed them on Dec 3rd inquiring about my paperwork and they replied within a few hours saying my fiancee can pick them up.

My suggestion for you is after two weeks from now, start checking status of your case by going to the website below. Your case number starts with RNG******. Make sure you select "IMMIGRANT VISA (IV)". Once it shows "READY", e-mail US Embassy. They will let you know when to pickup.

She will need to do the following....

1) Fill out DS-160 online and print out confirmation page.

2) Fill out DS-157, DS-158, and Additional Page. They will provide her with the forms.

3) Need 2 passport size photos.

4) Original birth certificate, original notarized translation, and copy of each documents.

5) Original marriage/divorce/death from previous marriage (if any).

6) Original police certificate in Burmese and original notarized translation certificate.

7) Affidavit of Support I-134, which includes your W2, 1040, bank balance dating 1 yr, current employment letter. Also get letters from your bank. Ask them for verification letter.

8) Any court records (if any).

Drop them off at the embassy guard shack once she has put together. If they are satisfy with your documents, they will call your fiancee in two days and ask her to go for her medical exam. They will ask her to choose from International SOS or Parami hospital. Medical costs about approximately 170 USD. You can also pay in Kyats. Oh, and also be sure to have three more passport size photos to take them with her for medical.

Later on she will also need 265 USD for visa fees. She doesn't need it right away. I think she would have to pay when she goes for her interview. I will update you once I find out myself. Good luck!!

My employement letter was dated for Dec 24, 2014 thats when I was collecting all the stuff, so hopefully all that is still good at time of interview if not i will have to get one more redone.

I don't want to be pessimistic

we received ours on December 2nd and till now our case hasn't reached NVC

it's been for 50 days and last time we called USCIS they asked us to wait for 90 days to look for our case

it's frustration to wait all this time for something will take 1 minute work

Oh no. :shocked: So sorry to hear. Although I am not quite familiar with the procedure, I have read posts on here where people have co-sponsors. Can you ask your family or relatives to co-sponsor for you perhaps?

We have cosponsor but still they need more proofs of domicile

So in determining whether a sponsor living abroad remain domiciled in the U.S., USCIS and the State Department will consider whether the stay abroad intends to be temporary and whether the sponsor has “maintained an intent to keep his or her domicile in the United States, despite the temporary sojourn abroad.”

You have at least 3 methods of attack:

1. Just generally show that your job abroad was a temporary job and that you have strong ties to the U.S., such as proof of your voting record in the U.S., proof of paying U.S. state or local taxes, proof of having property in the U.S., proof of maintaining bank or investment accounts in the U.S., proof of having a permanent mailing address in the U.S., proof that you are a student studying abroad, or evidence that a foreign government has authorized merely a temporary stay abroad.

2. Domicile for U.S. Citizen Working Abroad for a U.S. Employer, Etc.: This includes a "public international organization in which the United States participates by treaty or statute." You need to show that you were regularly but "temporarily" working abroad for them.

3. Reestablishment of domicile: You can still sign and submit a Form I-864 so long as you satisfy the government by a preponderance of the evidence, i.e., providing “concrete evidence,” that the you will establish a domicile in the U.S. on or before the date the immigrant enters. In other words, you don't have to move back first. Just prove you have a home where you'll live in the U.S. (e.g,, an apartment lease or a letter confirming you'll live w/friends or relatives) and/or prove you have a job in the U.S. which you'll be taking up.
