Montreal - Bringing Spouse to Interview

Timeline

for the IR1 applications, I thought there would be one interview where petitioner would be questioned about proving domicile and the spouse questioned for visa itself? So both of us would need to go to Montreal?

No...not required(In Canada) for k1..cri1/ir-1.....Simple as that! The American citizen can go into the consulate with you.....they may or may not be allowed into the actual interview

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I seem to read a lot about USC petitioner being given a hard time at the Montreal consulate about proving domicile (where the petitioner has show US rent agreement, US job offer, voter registration). At what time during the process does this particular interview take place?

U need to be going to the IR-1 forum and reading over the process, they have laid out the steps 1 by 1..believe Sylea even has a great blog on it.....The interview is at the end.....and if the American is already living in the USA, it's not an issue..only is if they are living in Canada

My interview was almost two years ago now but at that time my husband was able to come without any issue. I was glad for it because I also had my kids with me so they hung out with him while I visited the first window. When we went for our interview which was at another window and not in an actual room or anything he just hung back with the kids on a bench and I talked to the person at the window. He was allowed in without any questions. He just had to present his passport.

Again, that was coming up on two years ago now so perhaps it has changed but even if he couldn't have come in with me I would have wanted him there immediately after to celebrate together!

That documentation is given over to the NVC or on interview day (the beneficiary is the one who has an interview, not the petitioner.) It is the beneficiary that gives over that information if necessary (aka only if the petitioner is still living in Canada and has not already moved to the USA and only in IR1/CR1 cases.)

In which form does the petitioner specify if she has already moved to the US? For example, in our case, petitioner is still in Canada when sending the i-130, but within a 1-4 months after that, petitioner will have:

registered car to my name

car insurance to my name

address and rental contract

and hopefully before interview times, will try to get a job offer letter.

During the processing of the IR1, I will go back and forth to US to iron out some things.

Even at the time of the interview, even if I'm physically in the US, I can fly back to attend it with my husband. Although, it seems to me that telling them that I have already moved might help squash any domicile questions the may have. Just need to figure out most pain-free strategy.
