i was checking the NYS Marriage Bureau website..and it says that both applicants have to have a social...how does this work with the K1 visa...

when he comes in... he get the temporary 90 day work authorization issued at JFK

then go and get the social security number

then we apply for the marriage license?

or get married then do the whole social security bit?

i was lookng at a lot of ppls siggies and u guys seem to get married first then apply for the social security card..

has any new york members been through this and can offer some guidance

Here is some info about getting a SSN before marriage....

An individual with K-1/2/3/4 status applying for a work authorized SSN must present evidence at an SSA office to establish his or her age, identity and current lawful employment authorized status.

Note: Checking off on the DS-230 to be assigned an SSN DOES NOT aaply for individuals issued K visas. That is only for individuals age 18 or older that have been issued an immigrant visa and all K visa classifications are non immigrant.

The applicant needs to provide at least two documents as evidence to establish age, identity and current lawful employment authorized status. If one document is used for identity and employment authorized, another has to be provided for age.

SSA will not assign an SSN or issue a card to an individual that is within 14 days of his or her alien status expiring. Until the 76th day after entry an individual with K-1 status only needs to provide an unexpired I-94 showing current K-1 status to establish employment authorized status for SSN purposes.

Once, an individual that entered the United States with K-1 status has been in the United States 76 days he or she will need another document, i.e. I-551, I-688B or I-766 to establish employment authorized status for SSN purposes.

From day one of entry individuals that have entered the United States with K-2/3/4 status must provide an I-551, I-688B or I-766 to establish employment authorized status for SSN purposes.

We are in the same boat - we will be living in NYC and want to get married at a Hindu temple here before the K1 expires so K will need his SSN as soon as he can get it. I have read elsewhere in VJ that the K1 holder should wait 2 weeks before applying for the SSN because it takes that long for his/her arrival to be noted in the system so that is something to keep in mind.

I have read in other forums on this site where ppl coming in thru JFK can get a temporary work auth stamp or something to that effect to use to get the social..if thats the case...we can wait out the two weeks then go to the social security office and then apply for the social..

You do not need a temp EAD stamp from JFK to get a SSN.... all you need is your K1 visa.. it is advised to wait 2 weeks from entry to allow time for your information to be in the system... some people apply before the 2 weeks and have no problems others after the 2 weeks and their info is still not in the system... but you do not need the temp EAD to get a SSN...

Both the prospective bride and groom must appear together in person to apply for a marriage license. The application must be completed in our offices. The application consists of an affidavit wherein the applicants list various personal details such as their name, address, and birth place, date of birth, social security number, and marital history and make a sworn statement that there are no legal impediments to the marriage.

but then it goes on to say this

All applicants must bring valid forms of identification when applying for a marriage license. Expired forms of identification will not be accepted.

Valid forms of identification are as follows:

3. Learner's permit from New York State only

4. Active duty United States military identification card

5. Passport

i supposed..you are right...so i guess we can just go with his passport to the Marriage Bureau then start the social security deal afterwards

We had the same problem when we went to get our Marrage Licence - I just showed my passport with K1 visa and birth certificate and there was no problem.'

I had applied for my SS number however we did not have it in time.

People do advise wait two weeks before going to the SS office - I waited 3 weeks and was still not in the system.

THe SS office advised I could have just come in as soon as I got to US and applied - they then take application and refer to USCIS or DEPT of Homeland Security to confirm everything is legit - It took around 7 weeks to get my SS number

i jsut found the answer to my own question

Q. What proof do I need to obtain a marriage license?

A. A person is required to establish proof of identity and age (persons who are or appear to be under the age of eighteen only) by submitting to the issuing clerk one of the following identity related documents:

* Valid driver's license (from the United States or any of its territories)

* Valid non-driver's identification card issued by the department of motor vehicles (from the United States or any of its territories)

* Valid learner's permit from New York State only

* Passport

* Active military identification card

* Valid United States alien registration card

* U.S. certificate of naturalization ( issued within the past ten years)

* Employment authorization card issued by the Bureau of Immigration and Customs of the Department of Homeland Security

And, if applicable, one of the following age related documents:

* Birth Certificate

* Census record

* Baptismal record

* Passport

* Valid driver's license (from the United States or any of its territories)

* Life insurance pliicy

* Scholi record

* Immigration record

* Naturalization record

* Court record

There is no residence or citizenship status requirement.

Hi Chelben,

Good luck on your own immigration journey! In answer to your question, from my own experience, you don't need a SS# in order to get married in NYS. I got my SS# after I got married, and got my Green Card. All you need is other government-issued identification (even if it is foreign. For example, a passport, driver's license, birth certificate, etc.), in order to get married here in NYS.

A K-1 holder can get an SSN within a few weeks after arriving in the U.S.

Having SSN can be helpful when adding your fiancee to your bank account, and later applying for a drivers license in the state of NY, the SSN is required along with EAD or Green Card to apply for a drivers license.

Commenting on the quote below: not only is a SS# helpful, it is NEEDED for a NYS driver's license, bank account, or another financial information or transactions.....Grrrr....(and believe me, from my own experience, waiting for four weeks or more for an SS# makes getting the Green Card seem like an easier process...).
