Hello, My name is Adam. I came from Indonesia. I got my K-1 visa on May 2014. We married here on August 1st 2014.

I already have my Social Security Number.

My visa is expired on October, 22nd 2014.

here are my questions

1. Is there any fee waiver for me to get greencard or changing status? because it costs $1,100 for the application (greencard/changing status)

2. Am I legal to work without having greencard?

3. Is it okay for me to stay here while my visa has already expired? In otherhand, I am already married to US citizen.

4. Please tell me the documents that I need so that I can work legally here.

I have no idea about what documents that I need. I am blind about the immigration stuffs. Please help!

3. Technically yes, but eventually you need to adjust before you get into trouble.

4. To be honest, I have not even begun to research everything needed to complete this so someone else can answer.

2. Am I legal to work without having greencard? You cannot legally work without your EAD card, which, if you apply, you will receive about 90 days after you file is received.

3. Is it okay for me to stay here while my visa has already expired? In otherhand, I am already married to US citizen. Your K-1 expired the day you entered the US. You can stay but you will not be able to legally work.

:guides: for adjustment of status. First you need to apply for your AP/EAD in order to travel out of the US and to work legally, in the meantime the application for your two year green card can be processed.

June 2013: Met whilst working at a summer camp in Michigan

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

August 8th 2018: Window opens to submit naturalization application

February 6th 2019: Interview Date! APPROVED!

Read the guides as Boiler said, or USCIS instruction to form I-485 - which has everything you need to know and which is the form you need to submit. It also has the correct fee listed.

3. Technically no.

4. EAD or GC. Won't get those without adjusting the status.

You need to submit I-485 along with I-864 (Affidavit of Support - hopefully your wife meets 125% of poverty limits). Read instructions, it will tell you everything you need to know.

The fees are listed here > http://www.uscis.gov/i-485

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.
