Mother at nvc, child still at uscis, please help!

Hi,

i asked this question several times on this forum but nobody seems to be knowing what to do, :crying:

please good people help me out here

we(my daughter and i ) applied at the NSC and got transferred to california, on 10/29 my case was approved and sent to NVC, on 12/11 i got a welcome letter with my case and invoice numbers. meanwhile my daughters case still remains at uscis with no updates. my husband called their service number and spoke to them in person and i put in an e-request on the 11/6 to which uscis responded this-

Your petition is still pending consideration. We regret that we are not able to give you a timeframe for when we will complete the review of your petition.

i tried to start a new e-request this month but it wont let me (last request was 37 days ago)

now im confused

what am i supposed to do? proceed with my case at NVC? wait for my daughter to get approved? can i expedite my daughter somehow? what is the best thing to do?

im sure im not the only one on this forum who immigrated with kids, please give me an advice

suggest petitioner engage with immigration liason staffer on Monday, use a telephone after:

1. faxing in the non-disclosure form.

2. emailing in to the ILS human a long explanation of what the problem is, asking for congressional inquiry and expedite - as the two casefiles were separated at USCIS [something that's not supposed to happen].

The petitioner will need to do some research this weekend, today-ish, learn which Congressmen he's zoned to (there are 3 - 2 Senators, 1 Representative) then study each website on each Congressman - see if they are even open next week....

It takes 2 or 3 days to get it started, this inquiry via a Congressman, but it's going to be the quickest thing for resolution - National Call Center, even to talk with an ISO, is very disconnected to the actual casefile - an ISO there can request things of the adjudicating office, but it's slower approach (they want 30 days) than engaging an ILS human.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

hi

you can also delay your process if the other doesn't result, you can pay something and then not send in the paperwork, you have up to 1 year from the date that that form was requested to send in the form or documents. then it takes 60 days for them to review the documents

delay the process would be the last thing i want to do :( we have been in the process since april now and its making me sick. also i have some personal problems here and if i delay the process much longer i will simply end up homeless cuz my crazy ex is trying his best to get our house sold as early as possible

non-disclore form on each Congressman's website .

Boxer is a Senator - there are 2, each state - anyone/everyone can use.

is also a Representative - can research it by petitioner's zip code online.

I don't keep up with gov websites, sorry... but all the info is available - it's out there.

Hey *iri*, I'm sorry that you still haven't gotten any answers. :( I still don't have a clue how to help you but I wish I could. You should use one of these websites http://www.opencongress.org/people/zipcodelookup and then from what I heard from people here on VJ, every representative's website supposedly has the release forms ready to print and fax, which you have to do before they can help you (well, your husband has to, I'm sure). Best of luck.

You must delay your process at the NVC to have a same day interview with your child. Your choice. Delay and interview with your child or go to two different interviews an unknown period of time apart plus pay an extra $120 for AOS because the case files are not joined at the NVC.

Also if you don't delay paying your IV until your daughters case catch up then your petition will continue to process through {closing the window for your cases to be processed together}, til completion and you will have to wait for hers. But also you don't want your visa to expire while you wait, which could be months.

i found the senator (barbara boxer) and the form my hubby has to fill out and fax to them, which he will do on monday.

i really hope this works, cuz im close to a meltdown, like most of us i think :cry:

if he can fax today, sunday, that will shave a day. just saying.

when he calls in on Monday, ask for the name and email address of the Immigration Liason staffer.

Then he's to fire off the email - the contents of which, I hope, he's been prepping now.

I hope you two can shave off as much time as possible, as Constituent Offices have a wonky holiday closing schedule - I pray you two 'get in' with a human on Monday, who then has to schedule their own time to research and reach-out to the Congressional Liason officer at that USCIS service center.
