Anybody getting Insurance (Obamacare) for parents going through Adjustment of Status process

Hi friends

We have filed I-130, I-485, I-765 for my parents. They each recieved NOA which shows the Alien No. Also a month back, they completed their Biometrics. We are guessing it would take 2 to 3 months to get their GC. We are currently thinking of a enrolling my parents under Covered California. On contacting Covered CA Customer Care, I got different answers each time I called them.

Version 1
I was informed they are not eligible till they get a GC because SSN is necessary for enrollment. However, their website says that a person going through an immigration process can also apply for Covered CA
- Is this true? Does anybody have any experience in this?
- Has anybody got Obamacare insurance for parents while waiting for their GC?

Version 2
I was informed that even if my parents are eligible, my mom (64 yrs) would get Covered CA but my dad (68 yrs) would automatically get Medi-Cal ONLY because he is above 65 yrs
- Is this true?


Also, post my parents getting their Green Card (which obviously will happen only in 2015), they do intend to file Joint Tax Returns here in the USA for the year 2015 because they do get Pension in their home country (internationally) and have some investments too. So they would show this International income as their Source of Income.
- So we were told that while trying to getting them enrolled under Covered California, we should show their Income as "Zero" because as of now they have not recieved a Green Card, they have never filed Tax Returns in the USA, while filing the Affidavit of Support for my parents we showed our Income to support them. Is it ok to do this?


Would appreciate your feedback. Please help.

Obamacare isnrun by the States and you have to be resident in a State to get it.

My understanding is that you can not get it in anticipation of moving.

When they enter and take up residence they will immediately be eligible.

New GC holders have to wait 5 years before they can buy into Medicare.

They will be taxed on their world wide income so whatever that is would be the figure.

They came here on a visitor's visa and we applied for Adjustment of Status.

Thanks for responding but I don't understand your reply. We have filed the AoS and gone through

biometrics and are now waiting for interview/approval which may take some time into next year.

Does that mean they can/should apply for Obamacare or do we wait till the green card is at hand?

https://www.healthcare.gov/immigrants/immigration-status/ indicates that an applicant for LPR status is an eligible immigration category, although I suspect right now it's the case that they can choose to enroll rather than having to.

Given their ages, their premiums are likely to be steep.

I am going through the same situation as what you laid out below (in the state of NJ). Can I ask if you were able to figure out whether AOS is sufficient for someone to apply for Obamacare?

Also, if they want to wait until they get their GC, do they qualify for the special enrollment period?

Would appreciate any input you might have gathered.

They need a NoA to be eligible. that would start the special enrollment period.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think they will need SSNs to enroll in Obamacare, AOS by itself should not be a problem. Adjustment to LPR is an "eligible immigrant status".

Best consult a healthcare navigator local to you. NGOs provide this service for free. Search online, you should be able to find someone.

Btw, clock's ticking, Jan 31st is the deadline for regular enrollment. If your parents were entering the US at a later date, they would qualify for the special enrollment period, not sure for AOS though.
