Hi,

Im scheduled to file in early Feb to remove the conditions. But I recently found out my wife has been cheating on me. We tried to make it work but its going tough and a divorce seems imminent. How does this affect my situation? We will most likely be divorced, in the process of it before I am due to file.

february is two months away from now, and depending on the state you live in it can take several months to finalize. States like a South Carolina, Maryland and others require a year of separation first. So you may look at what your State's law is regarding divorce...

seek a waiver when filing 751. if you do not have your divorce decree USCIS will probably keep your case pending till you can send it to them. if you have strong evidence of a legit marriage from the time you married to the time you divorced you have nothing to fear.
