My wife's married name?

My wife has been going my her old name for 3 years. She would like to go by her married name. It is really really annoying when everyone asks..'same last name?" and I have to reply....no...its different .....and I get strange looks.

1} Will the removing of conditions allow her to actually go by her name after we got married?

2} if so how do I make that happen?

3} Will she get a new social security card and SS number, since her current ssn is her old name? .

4) should I use her name on the Green card and SS card to fill out the I-751?

5} Also is it a really good idea to get affidavits like I did for the CR-1?

Thanks, Brad

Has she legally changed her last name?

If she wants to take your last name, she will have to apply for a new Social Security card (the number won't change)
I would use her current name on the form (I am not sure if she has changed her name yet...so whatever her name is legally, use that)

She can change her name now. She can go to the SSA office and get a new SSN with her married name. Apply in her married name and her new green card can come in her married name. After you get the SSN go get her driver's license or state ID changed too.

Other names uses would be any previous married names and her maiden name.

If I went to the SSA and got her name changed we would be cutting it really close. We only have 1 more month to get it in (Jan 23), so I am not sure that going to the SSA would be a good idea right now......... unless....... we are positive it would only take a week?

1.a.. If we tried to go to the SSA and get a change of name on Monday. would it come back quickly?

1. Can we change her name after she gets the new card?

2. If we change her name after she gets her new perm res card, would that effect anything legally with NVC or anything?

3. Would she be able to get a new perm res card after we change her name? would it matter?

Any suggestions?

Thanks, Brad

It will cost $450 to change her last name on her green card. Your choice.

1) why do you only have a week? is her green card expiring in a week?

2) nothing is done with the NVC after getting the visa. It's all with the USCIS.

3) see other post

3) see other post they receive the package.

The package has to be there by the date her passport was stamped right? as long as it is there before that day im good to go right?

Would I have enough time to change her name through SSA?

You do not even have to get the name changed on her SSN first. No need to wait for an SS card in the married name, The SSN does control her name/identity. Apply in the married name. Use the maiden name when it asks for other names used. You can even include a copy of your marriage certificate, if you wish, to prove her legal name change. The marriage cert acts as the legal name change document. Add a note on your cover letter to state that she recently took the married name and that is why your evidence shows her maiden name but she is filing with her married name now.

If she wants to use the married name now, then she should do so and get her 10 year green card in the married name. It would take months and hundreds of dollars to change the green card later if you don't.
