Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

1- it shouldn't matter re: evidence from one person more than the other.

2- even with a joint sponsor, hubby will have to submit a sponsorship i864 form and his tax info. The form asks for other info as well.

Although your husband is not working and he can therefore show little evidence of money he has spent such as plane tickets, evidence is more than just money spent. They need evidence of a bona fide marriage/ relationship. It costs nothing to be in love. My husband works nights cleaning in a restaurant kitchen because he's still at college. We have no money at all. Every penny that we do have goes on tickets and so on. However, I have a box of cards he has made me, sketches he has done, love notes he has written, cards that his family have sent me for my birthdays over the years we've been together, emails and Skype call logs between us, cards that friends have sent to us as a couple when we got married and also for religious occasions, and so on.

Your situation is confusing to me. How do you communicate now that you're back in the UK? Surely you have emails/texts between you? That is more evidential of a relationship than a seat on a plane. You say you have come back to the UK because of the money situation so you were working in the USA prior to that? What visa did you have then? Surely you were on a lease together, filed taxes with him, had a bank account together. Were you on his car insurance? Were you named as a beneficiary in a life insurance policy? Or him in yours? Did you co-sign for each other for credit for anything? Car payments? Credit card? Store credit?

I think your greatest evidence is that you have already lived together there and you have worked there. The lease will be the best thing.

But I'm confused about why the need for CR-1 if you've already got a visa? You're not immigrating because you've already done that before. Although without knowing which visa you had when you lived there it's difficult. Was it a permanent one?

Now I'm really confused. You said your husband lost his job a few months ago but you also say he has been out of work since you met. Did you only meet a few months ago? When were you working and living there?

It helps if you list the full sequence of events so that people can give the right advice.

I have never lived or working the usa. I just go over whenever I can possible. We have only been married for a few months. Yes we have things like Xmas cards, congratulations cards etc etc and we communicate with iphone FaceTime audio as its free for us to use.

It's very hard as newlyweds to get everything together. We did apply for joint lease but they declined the application as I do not have a ssn. But we do have joint bank account.

The proof you need is more about the relationship. The affidavit of support takes care of the financial side. What the immigration staff are looking for is proof that you married for love and that you want a visa so that you can live as man and wife because you can't bear to be apart. They will want to know how many times you saw each other before you got married, how long for and how long you have been together. They will ask if you have met his family and if he has met yours. That sort of thing. We are also newly weds (September 27 this year) - we had a lot of Facebook comments from people about the wedding, congratulating us and so on. Do you have anything like that you could print? We got married with just us, 2 witnesses and an officiant. No big event. I'm sure they will understand that not everyone has an album full of professional photos.

I'm thinking it might be better for you to apply for a UK visa for him. After all, you're the one with the job and stability here. Being together is what matters. Good luck to you both.
