What can I do next? Want to stay in UK (merged)

Hey there, new to this place and I need some help. I am from the US and I came to the UK (N. Ireland) in June to visit my boyfriend. I got stamped for 6 months so my stay is coming to an end. My boyfriend and I just decided to get married. We got married yesterday. (Dec 11). Is there ANYTHING I can do to remain here in the UK? I would rather not leave the UK.

This is an immigration board for advice on how to move to the USA so not many people will have the experience you are looking for.

You will need to confirm you are eligible to apply, and that your husband has the financial means to sponsor you.

This is really just a forum for people trying to get TO the US. While someone might know, you'll probably have more luck googling a forum specific to immigration to the UK.

It might be that you have to leave and apply for a spousal visa from the US though, I am not sure if the UK has a similar system of adjusting status to the US.

Ask your question on UK Yankee but I also recommend getting an experienced immigration lawyer over there and double check before your visa runs out.

You don't want to create an overstay just in case you have to go back because that could make your spousal application more problematic.

It's usually a much quicker process than the US one so if you do have to go back you shouldn't be apart for very long.

The hardest part of the UK process at the moment is the financial requirements for the sponsor because unlike the US there are no joint sponsors, your husband will have to qualify for the financial requirement on his own.

It would certainly be possible to leave the UK, return home and apply for a spousal type visa. However, understand the following: a lot of rule changes to immigration to the UK have made it extremely difficult for families to remain together. Your UK spouse must prove that he, and he alone (your finances DO NOT count) makes up to a certain threshold, and I have to tell you, that threshold is pretty steep at £18,600 in a confirmed long-standing job per year or savings of well over £60,000 . You will also not be eligible to work in a timely manner as your husband could in the US. If there are any children had, the threshold also increases as to his financial burden of proof. This is why many UK/US (non EU) couples have had to make hard choices to leave their countries behind and go elsewhere in order to live. I would suggest never ever overstaying in the UK, and would also suggest that you should do a lot of research or consult a lawyer because you will have some pretty big decisions to make now.
