Hello!

I am currently an international student from China. I got married to my husband who is US citizen last September. We have been working on the green card application since then. So far it has been straight forward though it's very tedious. Now we are working on i-864 forms, and that's where we are stuck on. So here is the situation

My husband and i live with his parents (my husband and i are currently master students... poor us). His parents are willing to sign for joint sponsor. However, with combined federal income, they only made $ 21k last year. So we asked my husband's sister to sign up as our joint sponsor. She made about $27k last year. BTW his sister doesn't live with us. So my question is how do we fill out i-864 form? Are his parents fill two separate i-864 forms (they filed tax together), then his sister has to file another i-864 form? So combine of four i-864 including my husband's?

Also we are little confused about how to fill out part 5 sponsor's household size. Can you guys make sure if this is correct for part 5?

For my husband's parents (his father's form)

1. 1 (me!)

2. yourself - 1

3. currently married - 0

4. dependent children - 0

5. any other dependents - 2 (including my husband and his mother?)

6. if you have sponsored any other persons on i-864 - 0

7. if you have siblings, parents, or adult children with the same principle residence - 0

8. combined - 4

For my husband's sister who lives in different house

1. 1 (me!)

2. yourself - 1

3. currently married - 0

4. dependent children - 0

5. any other dependents - 0?

6. if you have sponsored any other persons on i-864 - 0

7. if you have siblings, parents, or adult children with the same principle residence - 0

8. combined - 2?

For my husband'

1. 1 (me!)

2. yourself - 1

3. currently married - 0

4. dependent children - 0

5. any other dependents - 2 (including his parents?)

6. if you have sponsored any other persons on i-864 - 0

7. if you have siblings, parents, or adult children with the same principle residence - 0

8. combined - 4

Is this look correct guys? any guidance would be helpful. Thank you very much!

His father i864:

Currently married: 1

Any dependent: 1 if he lists your husband as dependent on his tax, I don't think so. 0 if he doesn't list your husband as dependent.

Total: 3 if he doesn't

Your husband i864:

Any other dependent: 2 if he lists his parents as dependents on tax, which is conflicting with his father's tax. 0 if he doesn't

Total: 2 if he doesn't

Actually, I have been thinking....

Do you think it's okay if my husband's sister file i-864 alone? Meaning his parents who live with us do not include their i-864 form? Since from what I can tell, the only dependent the joint sponsor has to claim is me. So do you guys think it's sufficient to just submit my husband's sister's i-864 and my husband's i-864?

Her income was $27k last year alone which is above poverty limit.

If she is not married, no other dependents on tax... Then only your husband and his sister need to do I864. In that case, her head-count is only 2 (you and her.) Good luck.
