after the k3 visa is given

Timeline

Hi everyone, I'm at the head banging point in this journey yet again. to let everyone know where we are at so far. I'll give an overview before my questions. Both the I-130 and the I-129F have been approved. the k3 is at vancouver and i've faxed the DS-230 part 1 in and just faxed the checklist and completed the DS-156 online. Our medicals are next week and I've requested march 7th for interview.P.S. petition expires march 14.My first question is

1) Do i need the I134 support form for interview?

2)When i'm given the visa how long do i have to move to the u.s. ?

3) Can i take the kids just to visit on spring break before we officially move in june/july?

4) Can i start ead before moving so its done when i get there?

I hope you all can pass on some wonderful advice .I hope at some point I'll be able to help someone here also. Thank you in advance wonderful VJ family members

When you enter in March you can activate the K3 and then you can file the I765, I think you will have to go back once for biometrics though.

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

Talk to cdancer who just went through a K3 interview successfully in Vancouver. From what I understand and have been told by others here who interviewed in Vancouver, Vancouver does not request a I-134... weird, I know.

But maybe to be on the safe side, bring it anyway along with other financials.

2007-04-17: Received at Chicago

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

are the kids getting K4 visas when you get your K3?

Yes, you can activate your K3 and then send in the application for the EAD while you're there for Spring break. However, you will have to make at least one trip back down for your biometrics.

This is not legally the spirit of the visa itself, and could jeopardise your status in the US, but lots of Canadian have done it with no consequence, or even notice as far as I know. As long as your intent is to settle in the US permanently at some point (I'm guessing once the kids are done their school year?) then I should think it wouldn't be a problem.

Thanks so very much yes i will talk to her, thats what confused me was canada said no to I-134 but i do have all his financial stuff here except his signed I134. Great to here i can start the EAD before moving, then i can apply for EI here and relax for a couple months while slowly job searching.

Montreal I believe requests an I-134 (but not Vancouver)... I think Jerseygirl said she needed to submit one at the interview for her husband.
